In the event that sewage in any given case is composed of chemicals or other substances with a daily average BeD or suspended solids of ZOO or more milligrams/liter, the sewer user shall pay in addition to the rates and'charges set forth above an extra strength charge. The City shall determine when a customer is subject to the extra strength charge by use of City owned sampling equip- ment, and tests performed by City forces using procedures set forth in "Standard Methods for the Examinations of Water and Sewage." If it is determined'that the customer is sub- ject to the extra strength charge he sha.tl be directed to furnish his own sampling equipment at his own cost. Speci- fications for all sampling equipment and facilities may be obtained from the Director of Public Works. Persons discharging extra strength sewage (that with a daily average BOD or suspended solids in excess of 200 ppm) into a public sanitary sewer shall have the option of installing measurement and sampling facilities for the purpose of re- ceiving an industrial waste sewer service charge based upon continuous quantity and strength of the waste, or may elect to have their industrial waste charge based upon total measured water consumption from all sources and selected composit grab samples. Charges based upon total measured water consumption shall also be based upon the calendar month at which the maxi- ~t tko ~u-tr'' The r~ !t charge shall be applied uniformly over the entire calendar year. The extra strength rate is as follows: a. When based upon continuous quantity and strength of the waste: $0.004 per pound BOD b. W~en based upon selected composit grab samples and total measured water consumption: ($0.$$) x (each 200 PPM BOD or fraction thereof) 100 cu. ft. of water delivered Section 2. Sewer Service Charge Monthly Rate (Outside City). The rates for all service outside the city limits shall be two times the rate set forth in Section 1. Sewer Service Charge Monthly Rate (Inside City), of this ordinance. Section 3. Payment and Collection of Charges. Responsible Party. The person or firm normally making payment for water service shall be the one responsible and b~lled for the sewage disposal service fee. -3- Vacant Uses. Sewer service charges shall continue to be levied 'against the service recipient unless and until the responsible party requests and receives a disconnection 0£ water service at the parti- cular location. Delinquent Charges and Enforcement. The City of Ashland shall enforce the collection of sewer service charges by withholding delivery of water to any premises, the sewer charges for which are delinquent, and may use such other and further means of collection thereo£ as may be provided by the laws of the State o£ Oregon or by the Charter or Ordinance of the City of Ashland, and any delinquencies may be certified to the tax assessor of Jackson County for collection in the .manner as provided by Section 224.220, Oregon Revised Statutes. Rates and charges shall be billed approximately monthly and shall be declared delinquent if not paid on or before 15 calendar days from the date of mailing of the charge. Section 4. Normal curb line is defined generally in cases where there are no curbs as 20 feet perpendicular distance from the street centerline. Unusual circumstances shall be negotiated on a cost basis for labor and materials. C. All charges shall be made for laterals up to 6 feet in depth in excavation classed as common. Extra depth or rock construction shall be negotiated on a cost basis for labor and materials. D. Sewer connection charges shall be paid cash in full in advance at the time of request for service. Sewer connection work shall not begin until such charges are paid. In the event that connection is -4- made to an existing service prior to payment of fees as set forth above, water service shall be withheld or disconnected until payment is mad~ ~. All constructed premises located within 100 £eet of existing sewer trunk lines shall complete a lateral connection to and obtain service from such llne within six months £rom the effective date of this ordinance. All constructed premises located within 100 feet of newly constructed sewer trunk lines shall complete a lateral connection to and obtain service from such line within six months from the date that service is available. Provided, however, that in each situation sewage will flow by gravity to the sewer main. That any person failing to connect to the sewer trunk lines as heretofore provided shall be charged the appropriate rate as heretofore provided in this ordinance. Section 5. Penalties. A person violating this ordinance shall, upon conviction thereof, be punished by imprisonment for a period not to exceed 50 days, or by a fine not to exceed $200.00 or by both. ~,r~n 6.
