HomeMy WebLinkAbout1794 ORDINANCE NO. / 7~Y AN ORDINANCE PROHIBITING EXCAVATION IN NEWLY PAVED OR RESURFACED STREETS FOR A PERIOD OF FIVE YEARS AND PROVIDING A PENALTY FOR VIOLATION THEREOF. THE PEOPLE OF THE CITY OF ASHLAND DO ORDAIN AS FOLLOWS: SECTION 1. There shall be no excavation in newly paved or resurfaced streets by anyone including the departments of the City of Ashland for a period of five (5) years from the date of such paving. SECTION 2. At least ninety (90) days before any streets are paved or resurfaced the Director of Public Works shall give notice of such plans tO any utility company or department of the City that has requested of him to be so notified. In addition, such notice shall be given by mail to the owners of all property abutting on such streets and such notice shall be sent to their last known addresses. SECTION 3. The City Council may permit excavation within the five (5) year period if in its judgment the reason for the exca- vation was not reasonably foreseeable to the utility or department of the City involved at tl~ time the street w~s ~wly paved or resurfecedo Where an emergency involving the public health or safety require immed- iate excavationj the~ Director of Public Worke may permit 8u~h excavationj a~d fu~y report to the City Council at its next Council meeting. SECTI~ti $. The City ~ecorder is hereby directed to furnish a copy of this Ordinance to each department head of the City of Ashland and to each public utility or similar agency that does business in the City of Ashland. SEQTIpN 5. Any person, firm or corporation violating the provisions of this Ordinance shall be punished by a fine not to exceed FIVE-HUNDRED DOLLARS ($500°00), or by imprisonment not to exceed SIXTY (60) DAYS, or by both such fine and imprisonment. SECTION 6. This Ordinance shall be effective NINETY (90) DAYS from the date of its passing and approval by the Mayor.
