DECEMBER 27, 2000)

CITY AND CONSULTANT AGREE:
1. All Costs by Consultant: Consultant shall, at its own risk and expense, perform the personal services described above and,
unless otherwise specified, furnish all labor, equipment and materials required for the proper performance of such service.
2. Qualified Work: Consultant has represented, and by entering into this contract now represents, that all personnel assigned to
the work required under this contract are fully qualified to perform the service to which they will be assigned in a skilled and
workerlike manner and, if required to be registered, licensed or bonded by the State of Oregon, are so registered, licensed and
bonded.
3. Completion Date: Consultant shall start performing the service under this contract by the beginning date indicated above and
complete the service by the completion date indicated above.
4. Compensation: City shall pay Consultant for service performed, including costs and expenses, the sum specified above. Once
work commences, invoices shall be prepared and submitted by the tenth of the month for work completed in the prior month.
Payments shall be made within 30 days of the date of the invoice. Should the contract be prematurely terminated, payments will be
made for work completed and accepted to date of termination.
5. Ownership of Documents: All documents prepared by Consultant pursuant to this contract shall be the property of City.
6. Statutory Requirements: ORS 279.312, 279.314, 279.316 and 279.320 are made part of this contract.
7. Indemnification: Consultant agrees to defend, indemnify and save City, its officers, employees and agents harmless from any
and all losses, claims, actions, costs, expenses, judgments, subrogations, or other damages resulting from injury to any person
(including injury resulting in death), or damage (including loss or destruction) to property, of whatsoever nature arising out of or
incident to the performance of this contract by Consultant (including but not limited to, Consultant's employees, agents, and others
designated by Consultant to perform work or services attendant to this contract). Consultant shall not be held responsible for any
losses, expenses, claims, subrogations, actions, costs, judgments, or other damages, directly, solely, and approximately caused by
the negligence of City.
8. Termination: This contract may be terminated by City by giving ten days written notice to Consultant and may be terminated by
Consultant should City fail substantially to perform its obligations through no fault of Consultant.
9. Independent Contractor Status: Consultant is an independent contractor and not an employee of the City. Consultant shall
have the complete responsibility for the performance of this contract. Consultant shall provide workers' compensation coverage as
required in ORS Ch 656 for all persons employed to perform work pursuant to this contract. Consultant is a subject employer that
will comply with ORS 656.017.
10. Assignment and Subcontracts: Consultant shall not assign this contract or subcontract any portion of the work without the
written consent of City. Any attempted assignment or subcontract without written consent of City shall be void. Consultant shall be
fully responsible for the acts or omissions of any assigns or subcontractors and of all persons employed by them, and the approval
by City of any assignment or subcontract shall not create any contractual relation between the assignee or subcontractor and City.

SUBJECT: SYSTEM DEVELOPMENT CHARGES FOR STORMWATER
Dear Paula:
As requested, I have enclosed a task plan, budget and schedule for assisting the City of
Ashland in reviewing and redesigning a system development charge for your stormwater
program. Our communication to date and a review of the City's "Stormwater and
Drainage Master Plan" (June 2000) have provided a good basis for understanding the
issues of concern with the existing system development charge structure, along with
options to address these concerns.
My firm specializes in financial issues affecting stormwater management with specific
expertise in establishing utilities and system development charges for this area of
infrastructure. Coincidentally, my office location in Portland is in the same complex as
Tetra Tech/KCM, Inc., the engineers who prepared your stormwater plan. I have a long
and successful record of working with Tetra Tech/KCM in constructing SDC's
(Wilsonville, Sandy, Scappoose, Gresham, Hermiston, Rainier, Gervais) as well as SDC
work independent of Tt/KCM (Clackamas County, Unified Sewerage Agency, Oak
Lodge Sanitary District, Jefferson County, City of Sisters and West Linn). I am very
proud of the references developed with these clients and would be happy to provide them
upon your request. This experience translates into being able to work efficiently and
accurately with Ashland in developing an SDC structure that is consistent with ORS 223:
equitably recovers new development's fair share of stormwater system capacity costs.

PROPOSED SCOPE OF WORK

STORMWATER
Shaun Pigott Associates proposes a three-phase approach toward the redesign and implementa-
tion of Ashland's stormwater SDC. Phase 1 would be a review of the existing SDC methodol-
ogy and an assessment of the City's existing basis for documenting both current and future
SDC-eligible facilities. Phase 2 would design proposed methodologies for both the reimburse-
ment and improvement portions of the SDC based on the City's specific response to policy
issues affecting how capacity can be allocated, measured, and priced. Phase 3 would be the
SDC calculation itself, along with documentation of the methodology leading to the specific
charge. This proposed approach would include two briefings with the Project Steering
Committee and one briefing with the City Council. If and when meetings with other affected
parties, such as the Homebuilders, might be required, these would be attended on a time and
materials basis.
TASK PLAN
PHASE 1 -- REVIEW EXISTING SDC
a)
Prepare a data request including the City's financial statement; fixed asset records, facility
use data, master plans and/or capital improvement plans. The clear intent is to obtain all
capital facility lists, schedules, and costs developed through the completed master plan;
b) Review the information provided and conduct a status meeting with staffto review the ade-
quacy of the documentation, means for filling identified deficiencies, and the next steps in
the SDC development process; and
c) Evaluate and update funding assumptions and use estimates with emphasis on the cost of
planned projects and their consistency with adopted plans and/or CIP's.

a)
Based on the information developed through Phase 1, prepare optional approaches toward
SDC calculation for stormwater, which may include equivalent service units or other desig-
nated capacity allocation methodologies.
b) Evaluate these approaches relative to specific compliance with the provisions of ORS
223.297 and the definition of the reimbursement and improvement portions of the fee; and
c)
Establish specific policy statements relative to the preferred approach regarding credits,
valuation of existing capacity, indexing costs based on ENR data, consistency of growth
projections with development of future impervious area, allocation of improvement costs
between existing and future stormwater system users, accounting for SDC receipts, sources
of customer use statistics for stormwater, and other planning assumptions affecting the
SDC methodolog~j.
Phase 2 (40 hours)

PHASE 3 - SDC CALCULATION
Prepare an interim summary of the proposed storm'water SDC methodology for review by
staff and conduct a work session with the Project Steering Committee, including the docu-
mentation of the credit policy, SDC inputs, assumptions, and calculations;
b) Based on feedback from staff and the Project Steering Committee, make any necessary
revisions to the methodology and calculations;
c) Prepare draft revisions to the City's ordinance implementing the revised stormwater SDC;
and
d)
Prepare a summary-level report documenting the SDC methodology and present this report
to staff and the Project Committee within Ashland. The Council briefing would also take
place at this phase of the Project.
Phase 3 (35 hours)
