A RESOLUTION URGING THE OREGON STATE LEGISLATURE TO
OBSERVE THE RIGHT OF SELF-GOVERNMENT FOR OREGON CITIES AND
TO REFRAIN FROM PREEMPTING LOCAL CONTROL ON ALL MATTERS
BEST DECIDED BY LOCAL SELF-DETERMINATION.
Recitals:
A. Oregon cities have the utmost ability to assure local needs are fulfilled by local
people working with their local elected officials. Important local decisions that affect cities and
their citizens are best made locally than at the state level.
B. Observance and enforcement of laws is much more effective and efficient for locally
crafted laws than for state laws, which by their very nature cannot address the unique
characteristics of each community. The "one size fits all" type of state legislation rarely fits
locally.
C. The local educational and political process that accompanies passage of local
legislation ensures that these laws are tailor-made to succeed in their local communities.
D. Unless issues are of statewide concern which can only be legislated on a statewide
basis, state government should not preempt local governments from doing what is right for
their local communities.
E. State legislation that preempts local control reinforces the perception of many
citizens that their voices are not being heard. This perception is particularly intensified when
state preemption legislation is driven and dictated by special interests.
THE CITY OF ASHLAND RESOLVES AS FOLLOWS:
The Oregon State Legislature is urged to observe and honor the constitutional right of local
self-determination for cities. The legislature must refrain from preempting decisions by local
governments best suited to be made by local people working within the framework of their
locally elected governments. Only in extreme cases of statewide concern, which can best be
resolved by statewide legislation, should local preemption be legislated.
This resolution was read by title only in accordance with Ashland Municipal Code §2.04.090
