PERMANENT UTILITIES EASEMENT FOR CITY OF ASHLAND
1. Grant of easement. The above named Grantors grant to the City of Ashland, Oregon,
"Grantee," for the sum of $10.00, a perpetual non-exclusive easement in gross to construct,
reconstruct, install, use, operate, inspect, repair, maintain and remove and replace a sanitary
sewer line on real property described below and further referred to in this easement agreement
as the "easement area."
The easement area is located in Jackson County, Oregon and is described as follows:
See the attached Exhibit A.
2. Use of surface. Grantor shall have the right to use the easement area for all purposes not
inconsistent with the uses and purposes of the property, provided that Grantor shall not build or
place any structure upon the easement area without the prior written consent of Grantee.
3. Access to Easement Area. Grantee, its agents, independent contractors and invitees shall
have the right of ingress and egress to the easement area for the purposes connected with this
easement.
4. Notice. Grantee, its agents, independent contractors and invitees shall, upon every occasion
that such public utility facilities are constructed, maintained, replaced, reconstructed, or
removed, provide Grantor reasonable notice and restore the premises of the Grantor, and any
buildings or improvements disturbed by Grantee, as near as practicable.
5. Termination. All rights hereunder shall cease if and when the easement area ceases to be
used for public utility purposes.
6. Prior Encumbrances. This easement is granted subject to all prior easements or
encumbrances of record.

An easement 20.00 feet in width for the installation and maintenance of an underground sanitary
sewer line over, across and through Parcel 3 of that certain Minor Land Partition filed for record
May 19, 1977 and recorded in Volume 1 at Page 78 of "Minor Land Partitions" in Jackson
County, Oregon, and filed as Survey Number 6779 in the office of the Jackson County Surveyor.
Said easement located in the Southwest One-quarter of Section 4, Township 39 South, Range 1
East of the Willamette Meridian in the City of Ashland, Jackson County, Oregon, lying 10.00 feet
each side of following described centerline:
Commencing at the northeast corner of said Parcel 3, also being the northeast comer of Volume
t40, Page 608 of the Deed Records of Jackson County, Oregon; thence South 89°58' 1 l" West,
along the north line of said Parcel 3, a distance of 231.49 feet to the True Point of Beginning;
thence leaving said north line, South 18°03'00" East, a distance of 4.64 feet; thence South
03°57'00"East, a distance of 560.78 feet and the terminus of this easement.
Containing 0.26 ACRES, more or less.
The sidelines of this easement are to be prolonged or shortened as to meet at angle points, begin
on the north line said Parcel 3, and to end 10.00 feet southerly of the intersection of the centerline
described hereinabove and an existing 24 inch diameter sanitary sewer line of the City of Ashland.
Basis of Bearing for this easement is Geodetic North based on the North American Datum
1983(91) pursuant to Global Positioning System observations at City of Ashland published
Control Point Number 517. Reference bearing is the north line of said Parcel 3.
