Butler an& Linda Sue Butler, Husband and {rife, are the beneficiaries; and Whereas, Second Party is the owner of certain real property situated in Jackson County, Oregon described in Exhibit B attached hereto; and Whereas, the properties described in hxhibits A and B have a common boundary line and there is a question as to the exact location of said boundary line; and Whereas, the parties desire to resolve any and all boundary disputes between them concerning their common boundary line and to establish a common boundary line that separates their respective properties; NOk, Therefore, in consideration of the covenants and abreements contained herein, the parties hereto agree as follows: 1. The parties hereby covenant and agree that the boundary line common to and separating those certain real properties described in Exhibits A and B is and shall be in perpetuity that certain line described in Exhibit C attached hereto and made a part hereof, which line runs in a generally northerly-southerly direction. 2.
