HomeMy WebLinkAbout2672 Amending 4.26 Transportation UT FeesORDINANCE NO. ~ ~ AN ORDINANCE AMENDING CHAPTER 4.26 OF THE ASHLAND MUNICIPAL CODE CONCERNING THE USE OF TRANSPORTATION UTILITY FEES. THE PEOPLE OF THE CITY OF ASHLAND DO ORDAIN AS FOLLOWS: SECTION 1. The last sentence of Section 4.26.010 of the Ashland Municipal Code is hereby amended to read as follows: "The Council further finds that pedestrian facilities, including handicap access and bicycle facilities, are an integral and essential part of the transportation network and that a portion of such funds may also be used for construction of pedestrian facilities including handicap access and bicycle facilities either within or adjacent to existing public streets, or off of public streets." SECTION 2. The second sentence of Section 4.26.020 of the Ashland Municipal Code is hereby amended to read as follows: "Such fees shall be established in such amounts which will provide sufficient funds to properly maintain local streets and provide for pedestrian facilities including handicap access and bicycle facilities throughout the City." SECTION 3. The last sentence of Section 4.26.020 of the Ashland Municipal Code is hereby amended to read as follows: "The City Council may from time to time by resolution change the fees based upon revised estimates of the cost of properly maintaining local streets and constructing pedestrian facilities including handicap access and bicycle facilities revised categories of developed use, revised traffic generation factors, and other factors." SECTION 4. The second sentence of Section 4.26.030 of the Ashland Municipal Code is hereby amended to read as follows: "Such revenues shall be used for the purposes of the operation, administration, and maintenance of the local transportation network of the City and for the construction ofpedestrian facilities including handicap access and bicycle facilities." SECTION 5. The last sentence of Section 4.26.030 of the Ashland Municipal Code is hereby amended to read as follows: "All funds collected pursuant to the provisions of this Chapter for operation, administration and maintenance of streets designated as the "Transportation Utility Fee" and for pedestrian facilities including handicap access and for bicycle facilities construction designated as the "Special Transportation Utility Fee". SECTION 6. The last sentence of Section 4.26.090 of the Ashland Municipal Code is hereby amended to read as follows: "The fees paid and collected by virtue of this Chapter of the Ashland Municipal Code shall not be used for general or other governmental proprietary purposes of the City, except to pay for the equitable share of the cost of operation, administration and reconstruction of the local transportation network of the City and the construction of pedestrian facilities including handicap access and bicycle facilities and costs incidental thereto."
