HomeMy WebLinkAbout2675 Levying Special Benefit AssessmentsORDINANCE NO. ~.~/~-~ AN ORDINANCE LEVYING SPECIAL BENEFIT ASSESSMENTS IN THE AMOUNT OF $8?,905.55 FOR CURBS, GUTTERS AND PAVINO AND SANITARY SEWER IN LOCAL IMPROVEMENT DISTRICT NO. 64 AND DECLARING AN EMERGENCY. RECITALS: Be The City of Ashland has constructed curbs, gutters, paving, and sanitary sewer in local improvement district No. 64 during 1991-92. The total assessment for these improvements is in the amount of $87,905.55. The total assessments in this district are reasonable assessments. De Special benefit assessments should now be levied against property benefitted to defray the expense thereof. THE PEOPLE OF THE CITY OF ASHLAND DO ORDAIN AS FOLLOWS: SECTION 1. Any owner of property assessed for $100.00 or more may request the payment be extended in the manner and under the provisions of the Bancroft Bonding Act, if the request is made within thirty days after notice of the assessment is received. SECTION 4. All assessments using the Bancroft Bonding Act are required to pay in 20 semi-annual installments together with interest. Interest charged will be the actual bond sale rate plus 1 1/2 percent, with a maximum of 9.5 percent. SECTION 5. Inasmuch as it is necessary to provide the funds immediately with which to pay the cost of such local improvements, it is deemed necessary for the public peace, health, and safety of the citizens of the City of Ashland that an emergency be declared to exist, and this Ordinance shall be in full force and effect from and after its passage by the Council and approval by the Mayor. SECTION 6. Classification of the assessment. The assessments specified in Sections 1 and 2 of this ordinance are classified as not subject to the limits of Section 11b of Article XI of the Oregon Constitution (Ballot Measure 5).
