STATE OF OREGON DEPARTMENT OF LAND CONSERVATION AND DEVELOPMENT MEDIATION ASSISTANCE GRANT AGREEMENT DR 97015 By this agreement dated February 16, 1996, the Director of the Department of Land Conservation and Development, acting in behalf of the Land Conservation and Development Commission, agrees to providefunding tbr mediation activities for the period of acceptance of grant offer through June 30, 1996: Grantee Name: City of Ashland Grant Amt: $5,000.00 The Grantee, in consideration of the grant amount, agrees to perform the planning activities specified in the Conditions sections on the reverse side of this document, and agrees to all the Conditions of this agreement. If not accepted and returned to the Department of Land Conservation and Development before March 2, 1996, this agreement to provide funding is void. Grant payment schedule: Up to 1/2 of the funds as an interim payment. Payment request must be accompanied by a description of work performed and copies of billing from the contractor coveting the payment amount. Final reimbursement upon completion of all tasks, submission of required written reports and closeout materials, acceptance by agency grant manager, and receipt of detailed billing showing any in-kind contributions. Grantee data: Paul Nolte City of Ashland Attorney ********************************* For the Department of Land Conservation and Development Dale Blanton, Program Grant Manager February 16, 1996 Authorized Signature for the Grantee City Administ a~/O~ Name ~d Title Date: ~-20-96 DLCD Grant Manager: Donna Silverberg (378-3589 X830)* See Reverse for Grant Conditions MEDIATION ASSISTANCE GRANT AGREEMENT CONDITIONS The grant funds received by grantee pursuant to this grant agreement shall be expended only to accomplish and carry out the following activities: Retention of an impartial, third party mediator who will conduct pre-mediation preparation work, schedule, convene and facilitate meeting, prepare brief meeting notes and make a final report to DLCD. Progress reports on work completed as a result of this grant during the grant period shall be submitted by the grantee, if requested by DLCD. Any publications which may result from this process shall note funding was made possible from a grant by DLCD. All mediation proceedings and activities shall be accessible to persons with disabilities. A written summary and evaluation of the process (protecting all confidences), including time spent on the project and feedback from participants, shall be submitted by the grantee to the DLCD within 30 days after the end of the grant period. Eligibility for subsequent funding is contingent upon receipt of such reporting by the Department of Land Conservation and Development. Matching funds specified in the request must be shown within the closeout report. The grant funds received by grantee pursuant to this grant agreement shall be expended only to accomplish the activities approved by the Department. Standard accepted accounting and fiscal records will be maintained by grantee of the receipt and expenditure of funds pursuant to this grant agreement. Grant accounting records will be separately maintained from other accounting records. The Attorney General of the State of Oregon and the Director of the Department of Land Conservation (DLCD) or any other duly authorized representative, shall have access to and the right to examine any pertinent books, documents, papers, and records of transactions related to this agreement for three years after the final report is submitted. During the grant period, reports regarding work activities will be furnished promptly to the Director of DLCD if requested. If grantee shall fail to comply with any of the requirements or conditions of this agreement, the department may, in its sole discretion and without incurring liability therefore, refuse to perform further pursuant to this agreement. Should the department determine failure to comply, upon demand the grantee shall promptly repay any funds which are not obligated. Failure to fulfill the requirement shall subject the grantee to repayment of the total grant amount.
