Recital: Talent and Ashland recognize the likelihood that natural disasters, transportation mishaps or other emergencies may occur in their respective service areas and could reach such proportions as to render each party incapable of effectively dealing with such emergencies utilizing each party's individual resources. In consideration of the covenanfs contained in this agreement, Talent and Ashland agree: 1. The determination as to the availability of personnel and equipment shall be made by the duty officer of the agency receiving the request for assistance. 2. To make any requests for mutual aid under this agreement through Southern Oregon Regional Communications dispatchers. 3. To waive and release all claims whatsoever against the other for damage to property, loss of equipment, of injury to personnel or for the payment of any compensation whatsoever, arising in the course of, or as a result of, any assistance or lack of assistance rendered under the terms of this agreement. This provision does not waive the legal rights of any individual. 4. Nothing in this agreement shall be construed to restrict either party from billing a third party for services rendered. In the event the third party is a member of Talent' subscription plan, the undersigned agrees to accept insurance payments as payment in full. 5. This agreement shall remain in effect so long as bcth parties provid6 emsrgenc~,' medical services.
