SERVICES TO BE PROVIDED: Railroad Grade Crossing Evaluation Evaluate existing conditions of the nine at-grade railroad crossings within the City of Ashland and comment on the safety of each crossing. Provide narrative reports of the conditions and recommendations to bring each crossing to AASHTO roadway and AREMA railroad standards for actively protected grade crossing. Coordinate with CORP, ODOT Rail and Federal Railroad Administration for current and proposed improvements. (see also ScoDe of Services letter - HDR March 12,2003) ADDITIONAL TERMS: None CITY AND CONSULTANT AGREE: 1. All Costs by Consultant: Consultant shall, at its own risk and expense, perform the personal services described above and, unless otherwise specified, furnish all labor, equipment and materials required for the proper performance of such service. 2. Qualified Work: Consultant has represented, and by entering into this contract now represents, that all personnel assigned to the work required under this contract are fully qualified to perform the service to which they will be assigned in a skilled and workerlike manner and, if required to be registered, licensed or bonded by the State of Oregon, are so registered, licensed and bonded. 3. Completion Date: Consultant shall start performing the service under this contract by the beginning date indicated above and complete the service by the completion date indicated above. 4. Compensation: City shall pay Consultant for service performed, including costs and expenses, the sum specified above. Once work commences, invoices shall be prepared and submitted by the tenth of the month for work completed in the prior month. Payments shall be made within 30 days of the date of the invoice. Should the contract be prematurely terminated, payments will be made for work completed and accepted to date of termination. 5. Ownership of Documents: All documents prepared by Consultant pursuant to this contract shall be the property of City. Consultant makes no warranty, express or implied, that documents prepared by Consultant are suitable for any other purpose than this specific project. Any reuse by the City of Ashland or others of said documents are at the City or Other's own sole risk. 6. Statutory Requirements: ORS 279.312,279.314,279.316 and 279.320 are made part of this contract. 7. Living Wage Requirements: If the amount of this contract is $15,000 or more, Consultant is required to comply with chapter 3.12 of the Ashland Municipal Code by paying a living wage, as defined in this chapter, to all employees performing work under this contract and to any subcontractor who performs 50% or more of the service work under this contract. Consultant is also required to post the attached notice predominantly in areas where it will be seen by all employees. 8. Indemnification: Consultant agrees to defend, indemnify and save City, its officers, employees and agents harmless from any and all losses, claims, actions, costs, expenses, judgments, subrogation's, or other damages resulting from injury to any person (including injury resulting in death), or damage (including loss or destruction) to property, to the extent caused the negligent performance of this Agreement by Consultant and those to whom the Consultant is legally responsible. Consultant shall not be held responsible for any losses, expenses, claims, subrogations, actions, costs, judgments, or other damages, directly, solely, and approximately caused by the negligence of City. 9. Termination: This contract may be terminated by City by giving ten days written notice to Consultant and may be terminated by Consultant should City fail substantially to perform its obligations through no fault of Consultant. 10. Independent Contractor Status: Consultant is an independent contractor and not an employee of the City. Consultant shall have the complete responsibility for the performance of this contract. Consultant shall provide workers' compensation coverage as required in ORS Ch 656 for all persons employed to perform work pursuant to this contract. Consultant is a subject employer that will comply with ORS 656.017. 11. Assignment and Subcontracts: Consultant shall not assign this contract or subcontract any portion of the work without the written consent of City. Any attempted assignment or subcontract without written consent of City shall be void. Consultant shall be fully responsible for the acts or omissions of any assigns or subcontractors and of all persons employed by them, and the approval by City of any assignment or subcontract shall not create any contractual relation between the assignee or subcontractor and City. Main St Ashland, OR 97520 Subject: Railroad Grade Crossings Evaluation, Ashland, Oregon Proposal to Provide Engineering Services Ms Brown, Thank you for the oppo_rtunity to visit your beautiful city last month. As we discussed, HDR is pleased to offer our services to perform a small traffic study to identify and rank the existing railroad grade crossings in Ashland. HDR has prepared the following scope of work and fee estimate for a Railroad Grade Crossing Evaluation in Ashland. HDR proposes to complete the scope of work for a not-to-exceed cost of $15,000 (time-and-materials). Description of the Project The City of Ashland has eleven roads crossing the Central Oregon and Pacific Railroad (CORP) within the city limits. Two of the roads are grade separated (Ashland Street and Water Street) and nine of the crossings are at-grade. The City has received many complaints about the condition of the nine grade crossings including concerns with pavement buckling, tripping hazards, and inadequate bicycle and pedestrian access across the existing crossings. Pedestrian crossing panels are being installed at two of the crossings to connect to the Central Ashland Bike path that runs on the north side of the CORP tracks. The city would like to improve the gade crossings and evaluate the potential to add an additional grade crossing in the Railroad District near 4th Street and extend Normal Ave across the tracks to E. Main St. CORP operates local freight trains from Medford south to California through Ashland. They have a switching yard located south of Oak St in Ashland near the Railroad District. The railroad operates on a single track except where there are two tracks from Mountain Ave south of the yard and two tracks north of the yard through Helman Ave. Grade Xings Scope.doc HOREngineering, lnc. 1001 SW 5!h Avenue Suite 1800 Fax' i=fl31:123-7777 Nationally the railroad industry has been making significant efforts in the past decade to reduce safety issues at grade crossings. Since the grade crossings are generally easements across the railroad tracks, the financial responsibility to upgrade the roadway across the tracks generally resides with the roadway authority, in this case, the City of Ashland. Part of this national effort has included public/private partnerships to upgrade existing passive crossings to active crossing protection (signals and gates) and crossing surfacing improvements including installation of concrete crossing panels for the roadway and sidewalks. Nationally, the majority of railroads have the policy of no new additional grade crossings and a goal of reducing the number of existing grade cros. s_ings either by grade separation, consolidation or closure. Within Oregon, the Oregon Department of Transportation's Rail Division has taken the same position on reducing the overall number of_grade crossings by focusing on corridor projects rather than individual grade crossings. CORP has followed that approach on other projects in the Rogue Valley. The scope of work and fee described in this letter are based on this understanding. Scope of Work HDR proposes to evaluate-the existing conditions of the nine grade crossings within the City of Ashland from both the Roadway and Railroad perspectives. The grade crossings under evaluation are: 1. Tolman CreekRd 2. Walker Avenue 3. Wightman Street 4. East Main Street 5. North Mountain Avenue 6. Oak Street 7. Helman Street 8. North Laurel/West Hershey Street 9. Glenn Street The roadway evaluation will be based on the April 1998 Transportation System Plan (TSP), city provided 2003 traffic counts at each of the 9 gade crossings, and one site visit by HDR staff. HDR and Kittelson & Associates Inc. will review the roadway conditions for automobile, pedestrian and bicycle access and identify the projected traffic volumes in 20 years. For each crossing, the existing condition of the roadway will be compared to its roadway classification as identified in the TSP, by AASHTO, and by the Oregon Administrative Rules for clearances for Grade Crossings. Local connectivity issues will be identified ~vhich include maintaining safe routes to school and transit as well as emergency access routes. HBR Engineering, Inc. The railroad evaluation will be based on information collected from Central Oregon and Pacific Railroad (CORP), ODOT Rail, Federal Railroad Administration, American Railway Engineering and Maintenance of Way Association and the one site visit. HDR will contact the CORP railroad to determine current operations and planned track upgrades within the Ashland City limits from Tolman Creek Road to Glenn Street. A corridor wide inventory will be requested · from ODOT Rail Safety Division that identifies the existing equipment and accident history for each grade crossing. Upon completion of the investigation, HDR will prepare a short narrative report summarizing the results of the existing conditions investigations for the roadway and railroad portions, including color photographs. Included in this report will be a table ranking the existing conditions of the crossings and budgetary cost estimate to bring each crossing up to AASHTO roadway and AREMA railroad standards for an actively protected grade crossing. Based on that report, a next steps memo will be prepared that identifies the potential funding opportunities for improving the grade crossings and strategies for addressing ODOT Rail's and CORP's efforts to consolidate, grade separate or close as many existing grade crossings as possible and City of Ashland's desire to add two new grade crossings. Our team is ready to begin work the week of March 24, 2003 and will provide a preliminary report within 2 months. Total charges for this work shall not exceed $15,000, on a time and materials basis, without prior authorization. This assumes all meetings are held via conference calls other than the one-day site visit in Ashland.
