Permanent Pedestrian Easement for State of Oregon, by and through its
Department of Transportation
1. Grant of easement. The above named Grantors grant to the State of Oregon, by and
through its Department of Transportation, "Grantee," a perpetual non-exclusive
easement in gross to construct, reconstruct, install, use, operate, inspect, repair,
maintain and remove and replace a public pedestrian easement and sidewalk across,
along and upon the real property described below and further referred to in this
easement agreement as the "easement area."
The easement area is located in Jackson County, Oregon and is described on the
attached Exhibit A. ~
2. Use of surface. Grantors shall have the right to use the easement area for all
purposes not inconsistent with the uses and purposes of the easement area, provided
that Grantors shall not build or erect any structure upon the easement area without the
prior written consent of Grantee.
3. Prior Encumbrances. This easement is granted s, ybj~t t~o all prior easements or

EXHIBIT `A'
EASEMENT DESCRIPTION
A strip of land 6.00 feet in width located along the Southwesterly boundary of that
parcel of land as described in Document No. 99-22134 of the Official Records of
Jackson County, Oregon, the Southwesterly boundary of which being common to
the following described boundary line:
Commencing at a 2-inch diameter brass cap marked "T.39S., R. 1 E., C. S., '/4, S
32 / S5" monumenting the corner common to sections 32 in Township 38 South,
and Section 5 in Township 39 South, Range 1 East of the Willamette Meridian in
Jackson County, Oregon; thence South 1978.99 feet; thence East 1249.81 feet
to the Northwest corner of said parcel, being on the Northeasterly right of way of
North Main Street (Highway 99) in the City of Ashland, Oregon for the True Point
of Beginning; thence along said Northeasterly right of way, along a 1939.84 foot
radius curve to the right (concave to the Southwest) 218.54 feet (having a chord
bearing of South 35° 30'22" East, 218.42 feet) thence South 32° 16'43" East,
3.68 feet to the Southwest corner of said parcel for the terminus of this
easement.
