This Agreement is to be binding upon myself/ourselves, my/our heir(s), executors, and assigns, and it is my/our express intention that this Agreement shall run with the land, so that fulfillment of the items listed below shall be binding upon future owners of the property. ACTION: 1) THE OWNER HAS RECEIVED A BUILDING PERMIT TO CONSTRUCT A STUDIO IN THE DAYLIGHT BASEMENT OF THE SINGLE-FAMILY RESIDENCE AT THE REAR OF THE PROPRETY. THIS DOES NOT CONSTITUTE APPROVAL OF A SECOND RESIDENTIAL UNIT. THE OWNER SHALL NOT INSTALL A KITCHEN IN THE STUIDO SPACE STRUCURE FOR THE PURPOSES OF A SEPARATE RESIDENTIAL UNIT. USE OF THE ADDITIONAL LIVING SPACE DOES NOT MEET THE ZONING REQUIREMENTS OF THE ASHLAND MUNICIPAL CODE, AND IS A VIOLATION OF THE ASHLAND MUNICIPAL CODE THEREBY SUBJECT TO ALL PENALTIES THEREOF. 2) AGREE TO PARTICIPATE IN A LOCAL IMPROVEMENT DISTRICT FOR ALLEY IMPROVEMENTS ON THE ADJACENT ALLEY (SOUTH SIDE), AND AGREE NOT TO REMONSTRATE TO THE FORMATION OF SUCH LOCAL IMPROVEMENT DISTRICT; AND AGREE TO PAY ASSIGNED SHARE OF SUCH DESIGNATED IMPROVEMENT COSTS.
