SANITARY SEWER EASEMENT
Danial R. White and Charlotte L. White, hereinafter referred to as "Grantors", conveys to the City of Ashland, a
municipal corporation of the State of Oregon, hereinafter referred to as "Grantee", an easement to use a portion of
Grantors' property described below:
A strip of land, fifteen feet in width and lying seven and one half feet on each side of the following described
line:
Commencing at the Northeast Corner of Donation Land Claim No. :53 in said Township 39 South, Range 1
East, Willamette Meridian, Jackson County, Oregon; thence South 29032'47'' West, 2,365.61 feet to the Point of
Beginning of said easement on the east side of the pumping station as shown on Sheet 4 of the construction plans for
the North Mountain Avenue Sanitary Sewer L.I.D., Ashland, Oregon; thence East, 427.63 feet; thence South
67°31'58" East, 148.87 feet; thence 51.82 feet along a curve to the left having a radius of 200.00 feet, a central
angle of 14°50'44'', and long cord of 51.68 feet which bears North 79°06'43" East; thence North 71°41'21'' East,
168.14 feet; thence East, 359.55 feet to the West right of way line of Old North Mountain Avenue of said City of
Ashland, being the Point of Termination of said easement.
The terms of this easement are as follows:
Grantee, its agents, independent contractors and invitees shall have the right of ingress and egress and use of
the easement to construct, reconstruct, install, use, operate, inspect, repair, maintain and remove sanitary
sewer lines across and through that real property described on attached Exhibit 'A', as referenced
hereinabove.
The consideration for this easement is $1.00. / ~--~'~ 5 ?/ /- 7
3. This easement is granted subject to all prior easements or encumbrances of record.
It is the intent of the easement to define the true and actual location of the sanitary sewer pipeline as
constructed. If a conflict should arise between the described location and the actual location, the latter shall
prevail and the easement shall be defined by the sewer pipeline as laid.
