UTILITIES EASEMENT 'i ~ :O 7
J. Ervin Toney, hereinafter referred to as "Grantor", conveys to the City of Ashland, a municipal ~orporation of the
State of Oregon, hereinafter referred to as "Grantee", an easement to use a portion of Grantor's property described
on the attached Exhibit "A", incorporated herein and by this reference made a part hereof.
The terms of this easement are as follows:
1. Grantee, its agents, independent contractors and invitees shall have the right of ingress and egress and use the
easement to construct, reconstruct, install, use, operate, inspect, repair, maintain and remove utility lines, including
but not limited to lines for electricity, sewer, water, gas and telecommunications, and all necessary related facilities
over, across and through that real property described on attached Exhibit 'A', as referenced hereinabove.
2. The consideration for this easement is $1.00.
3. This easement is granted subject to all prior easements or encmnbrances of record.

EXHIBIT 'A'
A ten foot wide easement over a parcel of land situated in the north half of Section 9
and the south half of Section 4 in Township 39 South, Range 1 East of the Willamette Base
and Meridian, Jackson County, Oregon; said easement being more particularly described as
follows:
Commencing at a %-inch iron pin monumenting the Southeast corner of Parcel No. 3
of Partition Plat No. P-2-199l of Plat Records of Jackson County, Oregon and filed in the
office of the Jackson County Surveyor as Survey Number 12,354; thence North 89057'42'.
West, along the South line of Parcel No. 3 and Parcel No. 2 a distance of 101.00 feet to the
True Point of Beginning; thence leaving said South line, North 00°02'18" East, 104.24 feet
to the Southeast corner of a Public Utility Easement, thence North 89°57'42" West, along
the South line of said easement 10.00 feet to the Southwest corner of said easement; thence
South 00002, 18" East, 104.24 feet to the South line of said Parcel No. 2; thence South
89°57'42"East, along the South line of said Parcel No. 2, a distance of 10.00 feet to the
point of beginning.
