HomeMy WebLinkAbout1990-033 RESO 1990-28RESOLUTION NO. 90 - A RESOLUTION AUTHORIZING THE CITY ADMINISTRATOR TO SIGN SUPPLEMENTAL AGREEMENT 9114 WITH THE OREGON STATE HIGHWAY DIVISION. BE IT RESOLVED BY THE CITY OF ASHLAND AS FOLLOWS: · SECTION 1. The Oregon State Highway Division has awarded a bid for the construction of Hersey Street from Oak Street to North Main Street. SECTION 2. There are federal funds available and the Oregon State Highway Division has offered those funds to offset the City of Ashland's cost of construction engineering. SECTION 3. The City Administrator is authorized to sign the attached amendment to Agreement No. 9114. The foregoing Resolution was READ and DULY ADOPTED at a regular meeting of the City Council for the City of Ashland on the /_~ day of June 1990. Main Street Ashland, OR 97520 Ladies and Gentlemen: The Oregon State Highway Division (State) and City of Ashland (Agency) entered into a Local Agency Agreement on May 27, 1987, for the construction of the North Main - Water Street (Hersey Street) project. It has now been determined by State and Agency that the aforementioned agreement, although remaining in full force and effect, shall be supplemented by this agreement in order to reflect a change in the responsibilities for construction engineering. Any further reference said May 27, 1987, agreement shall include the following provisions: ATTACHMENT NO. 1, SPECIAL PROVISIONS, Paragraph 2 which reads: "2. Agency shall, at their own expense and upon award of a construction contract, furnish all construction engineering, field testing of materials, technical inspection, and project manager services for administration of the contract. The State shall obtain "Record Samples" at specified intervals for testing in the state Materials Laboratory in Salem." Shall be revised to read: "2. Agency shall, as a federal participating cost and upon award of a construction contract, furnish all construction engineering, field testing of materials, technical inspection, and project manager services for administration of the contract. City shall adopt a resolution authorizing its designated City Officials to enter into and execute this agreement, and the same shall be attached hereto and become a part hereof. This project was approved by the State Highway Engineer on June 20, 1985 in the Highway Bridge Replacement Program through 1989. Contract No. 9114 Jackson County The Oregon Transportation Commission, by ~ duly adopted delegation order, authorized the State Highway Engineer to sign this agreement for and on behalf of the Commission.
