HomeMy WebLinkAbout1990-037 Agrmt - Ashland Mine Rdcc: BEFORE THE BOARD OF COUNTY COMMISSIONERS STATE OF OREGON, COUNTY OF JACKSON IN THE MATTER OF AUTHORIZING THE COUNTY ) ADMINISTRATOR TO EXECUTE AN AGREEMENT ) WITH THE CITY OF ASHLAND FOR TRANSFER ) OF JURISDICTION OF ASHLAND MINE ROAD IN ) ASHLAND ) ORDER NO. ~V~] Bill Gaddis Carl Michael Dale Petrasek Willard Chapman Gerry Douglas City of Ashland WHEREAS, the city of Ashland desires to accept jurisdiction of Ashland Mine Road from Fox Street to a point 1,313 feet west; and WHEREAS, the jurisdictional transfer is contingent upon pas~ent by ,Jackson County to the city of Ashland of $17,037, which represents the cost of asphaltic concrete overlay; and WHEREAS, Jackson County desires to transfer county roads within city limits to the cities to reduce the county's maintenance cost of the road; and WHEREAS, it is considered that this agreement 'is beneficial to both Jackson County and the city of Ashland. Now, therefore, The Board of County Commissioners of Jackson County ORDERS: 1. The County Administrator is hereby authorized to execute an agreement with the city of Ashland for the transfer of jurisdiction of said portion of Ashland Mine Road. 2. The County Administrator shall authorize payment of $17,037 to the city of Ashland for asphaltic concrete overlay. DATED this 3rd day of July, 1990, at Medford, Oregon. ORDER - 1 3304.33 JACKSON COUNTY BOARD OF COMMISSIONERS as/, C~ir AGREEMENT This agreement is made this ~ day of ~ , 1990, between Jackson County, a political subdivision of the State of Oregon, hereinafter called "County" and the City of Ashland, an Oregon municipal corporation, hereinafter called "City": WITNESSETH: I Ashland Mine Road, from Fox Street to a point 1,313 feet Westerly is a county road within city limits. For reasons pertaining to its geographical location, the cost of maintenance and improvements to said road has become burdensome to County and it is desirable that the County surrender jurisdiction over said sections of road to city. II City, being involved in an ongoing street improvement program for roads and streets within the city limits, has need of funds in order to perpetuate said program. III In order to further the interest of both entities, it is mutually desirable that County contribute a sum of money or equivalent resources to City and City accept the jurisdiction of said section of county road within the city limits. This agreement is for the purpose of furthering said mutual interests. IV Following execution of this agreement, City shall formally request that County surrender its jurisdiction over Ashland Mine Road from Fox Street to a point 1,313 feet westerly and shall adopt such ordinances and resolutions as shall be necessary for the transfer of jurisdiction of said sections of roads pursuant to Oregon Revised Statute 333.270. V Following the jurisdictional transfer, but no later than August 15, 1990, County shall pay city the amount specified in paragraph VI, subject to the obligations and for the purposes therein provided. VI During the 1990-91 fiscal year, city shall acquire, construct, improve, or repair the following street or road section: Ashland Mine Road from Fox Street to a point 1,313 feet westerly to urban standards approved by the Jackson County Department of Public Works, which urban standards shall include an asphaltic concrete pavement in accordance with City of Ashland plans, dated April 18, 1990, for "Ashland Mine Road - Street Improvement Project". County's contribution shall be the equivalent of 3 inches of asphaltic concrete pavement, which cost is herewith established at $17,037.00. VII If this agreement is payable beyond the budget year in which it was made, it is payable from such county road funds received pursuant to O.R.S 294.060 as may then be appropriated for the~particular purpose of discharging the contract. .Executed this~.~ day of By: ~. ~/~..~?
