files.

eight years now at SOSC, I have welcomed, and valued, the opportunities to work

MEMORANDUM OF AGREEMENT
This agreement made and entered into this /~-~day of ' v , 1970,
by and between the City of Ashland (hereinafter called "City") and
Southern Oregon State College (hereinafter called "College") concerning
street improvements and street maintenance services in the campus area.
WITNESSETH:
WHEREAS, City maintains and improves streets in the campus area which
are of benefit to the College for access to College facilities
and housing for students; and
WHEREAS, City assesses a transportation utility fee to its residents and
businesses for these services, which is based on traffic
generated by required parking facilities for each use; and
WHEREAS, city and College dispute the validity of the claim by City on
College for the Transportation Utility Fee, and the parties
wish to resolve their dispute by this agreement; and
WHEREAS, while it is the College's position that it is not subject to
said fee, the parties hereto wish to identify specific projects
in the campus area which are equal to or greater than an in
lieu amount that the College is willing to pay for projects or
maintenance activities which benefit the College.
NOW, THEREFORE, in consideration of the provisions hereinafter set
forth, the parties do hereby agree as follows:
The College will pay to the City a monthly in lieu amount equal to
the transportation utility fee.
The City will annually inform the College of the projects or
maintenance activities within the Campus Area as delineated on
Exhibit "A" attached hereto and made a part hereof, which it
proposes to accomplish during the ensuing year.
At the end of each 12 month period, the City will provide to the
College, a statement of costs incurred by the City for the
completion of said projects or activities. Any in lieu payments not
expended will carry forward as a credit toward future years, and any
excess of expenditures over said payments will carry forward as a
debit against future years with a maximum accumulation of three (3)
years.
This agreement shall be in effect for a one (1) year period and
shall automatically renew for successive one year periods, unless
either party gives notice of its desire to cancel this agreement at
least six (6) months prior to its current expiration date.
