THIS AGREEMENT made and entered into between JEFFERY and ALA
RAE JONES, hereinafter referred to as "Jones" and the CITY OF
ASHLAND, OREGON, a Municipal Corporation of the State of Oregon,
hereinafter referred to as "Ashland" and as based upon the following
recitals, the truth of which is hereby acknowledged.
WITNESSETH:
RECITALS:
1. Approximately ten years ago Ashland, through a
contractor, undertook to make necessary curb repairs in the area of
the Jones's property.
2. As part of that repair work, the Jones' vehicle was
damaged for which they have never been compensated.
3. The lien, being ~128 in assessment district #51, levied
against the Jones' property for the curb repair is presently in the
amount of approximately TWO HUNDRED TEN DOLLARS AND 26/100
($210.26).
4. It is the intention of all parties hereto to settle all
matters in dispute between them with respect to both the lien and
the vehicle damage and all items in any way related thereto.
NOW, THEREFORE, based upon the foregoing Recitals and of the
mutual covenants contained herein, it is agreed as follows:
The parties hereto do in exchange each for the other's
relinquishment of any claims against the other, do forgive to other
to all claims with respect to the curb repair work and the vehicle
damage. The lien being #128 in assessment district #51 is hereby
cancelled and the Joneses are no longer indebted to Ashland for any
amount in connection therewith; further, the Joneses do cancel any
indebtedness due to them by reason of the vehicle damage.
In case of suit or action to enforce any rights or
conditions of this agreement and upon any appeal to a higher court,
it is mutually agreed that the loser in any such litigation shall
pay the winner's reasonable attorney's fees as determined by the
court, and upon any appeal such additional fees as determined by the
appellate court.
