Dear Mr. Garrett:
RE: Fence constructed on
Public Right of Way
Mr. Steve Hall and I recently had an opportunity to view the
wooden fence which you recently constructed adjacent to Courtney
Street. It was noted that the fence was constructed on public
right of way rather than on private property as is the usual case.
The fence does, however, appear to be well constructed and is set
back from the curb a sufficient distance to allow curb side access
to and from parked automobiles.
We feel that the fence as constructed will not be a
detriment to the use of Courtney Street by the general public. On
that basis, we will approve the fence as constructed reserving,
however, the right to full and complete usage of the entire right
of way width, if it is required at some future time. The full
usage of the right of way will necessitate your prompt removal of
the fence, without charge to the City, in the event that future
street widening, maintenance or construction should require it.
Please signify your agreement to these terms as listed above
by signing this letter in the space indicated and returning it in
the enclosed stamped envelope at your earliest opportunity.
