To expedite this matter, it is suggested that after the Deed is signed by you and the Mayor and Notorized, that you call Ruth Ritchie at Crater Title in Medford, 779-7250, and ask her to have their local office pick up the Deed and deliver it to her. Also, by copy of this letter to Ruth, I wish to confirm that she will, at closing, have all of the so-called important documents, such as the orginal of the Promissory Note and the Trust Deed, delivered to you as the Custodian of the City Records. AND BY THIS REFERENCE INCORPORATED HEREIN Reserving therefrom a perpetual easement for all existing power and water lines on the property at such locations as they presently exist and for the replacement thereof in the same location as the needs in the future may require and also for the purpose of going upon the subject property for the maintenance of said power and water lines; however~ an easement for existing sewer lines is not being retained. ~ Subject to: (1) Real property taxes; (2) City liens of the City of Ashland, Oregon, including liens and assessments for street improvements; and (3) Financing Statements, if any, filed in the office of the Secretary of State. It is acknowledged by the parties that this property has not been surveyed. Therefore~ the express and implied statutory warranties and covenants are hereby modified so that they shall not cover conflicts in boundary lines which a correct survey would disclose. If a future survey should disclose that the legal description attached as Exhibit "A" does not include property currently occupied by Croman Corp. under that certain lease dated October 1, 1978~ originally between the City of Ashland, lessor, and McGrew Brothers Sawmill, Inc., lessee, which lease was assigned to Croman Corp. and by Assignment of Lease dated January 11, 1983, and recorded January 21~ 1983, as Document No. 83-01044~ Official Records of Jaekson County, Oregon, then the City of Ashland shall quitclaim to the Grantee hereunder any property mistakenly omitted from the legal description.
