AGREEMENT
It is recognized that the hereinafter described land
uses or is permitted to use Talent Irrigation District irrigation
water from the City of Ashland. The right to the use of this
water is regulated and may be temporarily or permanently
terminated pursuant to the provisions of Ashland City Ordinance
No. ~{ %~ and as it may be amended in the future. The land
involved is located at 327 High Street in the City of Ashland,
County of Jackson, State of Oregon, more particularly described
as follows:
Commencing at a
1" souare i. ron bar situated at the intersection of the centerline
of Wimer Street with the west boundary line of Donation Land
Claim No. 40 in [ownship 39 South, Range 1 East of the Willamette
Heridian in Jackson County, Oregon, thence South 00°04'43" West,
along the west boundary line of said claim, 457.60 feet to a 5/8"
iron pin; thence, leaving said claim line, S.outh 89°55'44'' West
20.00 feet to a 5/8" iron pin situated on the westerly right of
way of High Street for the true point of beginning;'thence South
00"04'43" West, along said right of way and parallel to the west
boundary line of said claim, 15.00 feet to a 5/8" iron pin;
thence, leaving said right of way, South 89"55'44" West 141.75
Feet to a 5/8" iron pin; thence South 00°04'43" West, and
parallel to the west boundary line of said claim, 100.94 feet to
a 5/8" iron pin; thence North 89"55'30" West 141.75 tee~ to a
5/8" iron pin; thence North 00"04'43" East, and parallel to the
west boundary line of said claim, 115.58 feet to a 5/8" iron pin;
thence North 89"55'44" East 283.50 Feet to the point of
beginning.
The owners or contract purchasers are the persons who
have signed this document and they agree to the terms of the
above-referenced ordinance and as it may be amended in the
future.
This agreement is to run with the land and to be
binding on the heirs, successors and assigns of the undersigned.
