FOX, husband and wife, Grantees, the following.described real property free of encumbrances. Said real property is described in Exhibit A, which is attached hereto and incorporated herein and which is designated as Code 5~1, Account No. 1-9464-8, Map No. 391E16AD, Tax Lot 6201. The true consideration for this conveyance is fairness. This instrument will not allow use of ~he property described in this instrument in violation of applicable land use laws and regulations. Before signing and accepting this instrument, the person acquiring fee title to the property Should check with the appropriate city or county planning department to verify approved uses. BALTEI ATTORNEY AT LAW ASHLAND. 01~EGE]N 9752E] October 31, 198E Dear Jim: Enclosed for your ready reference is a copy of yout letter of September 22, 1988 to John Fox. It appears appropriate to request the Council to authorize the Mayor and the Recorder to sign a fei. ease of that easement. In the request it would appear to be helpful to the Council to have a very simple map showing the land involved, the location of the easement, and the location of 800 Liberty Street, which should c!ear].y indicate that 800 Liberty Street is not involved in the City's use of its easement. Could you prepare such a map? If you have such a map it would then be appropriate to forward the matter on to the Council. Enclosed is a Quitclaim Deed which also can go to the Council and be used to relinquish its interest in the easement. Mr. Fox is hopeful that this matter will be on the Council agenda for November 16, 1988 (it is a day late because the Council will be in Portland at the League Convention on' the 15th). Thus, please keep Mr. Fox posted so that he can be at the Council meeting to present his request and to answer any questions the Council may have. By copy of this letter I am sending copies of it all to Mr. Fox and suggesting that he monitor the matter with you from this point on. It is our feeling that the easement referred to is located quite some distance to the south and has no connection with any portion of lot 6201. It is our belief that when the original easement was acquired, the grantor owned a much larger parcel of land which now encompasses several smaller lots, with lot 6201 being included.
