WE, THE UNDERSIGNED, being the owners of the land described in
Exhibit "A", which is attached hereto and incorporated herein, do for
ourselves, our heirs, assigns and personal representatives, do covenant
with the City of Ashland, a Municipal Corporation of the State of
Oregon, that we or they
w~ not partition, divide or lease less than
the whole the land described in Exhibit "A" until such time it is
annexed to the City of Ashland. By accepting this Deed Restriction the
City of Ashland is not agreeing to annex said land at any particular
time nor under any particular circumstances.
The consideration for this covenant is that the City of
Ashland will allow the covenantors and the property described in Exhibit
"A" to be connected to the City's sewage treatment system.
Said covenant shall run with the land described in Exhibit "A"
and shall bind and shall inure to the benefit of the City of Ashland and
shall expire and terminate at the time said land is annexed to the City
of Ashland, Oregon.

Beginning at a point South 89046' East 558.70 feet from the most
southerly southwest corner of'Donation Land Claim No. 48 in
Township 39 South, Range i East of the Willamette Meridian in
Jackson County, Oregon (said point being the southeast corner of
tract described in Volume 372 page 323 of the Deed Records of
Jackson County, Oregon); thence North 28o16' West 196.42 feet;
thence West 40.0 feet; thence North 0°07L East, along the west
line of tract described in Volume 210'Deeds page 188, a distance
of 249.54 feet, more or less, to the southerly line of East Main
Street; thence South 69°29` East, along said road line, 800.0
feet; thence along the arc of a 1147.70 foot radius curve right,
to a point on the west line of tract described in Volume 243
deeds page 243, said point being 485.0 feet West of the east line
of said Claim No. 48; thence South, along the west line of said
tract, 6.0 feet to the south line thereof; thence North 89o46'
West, along said Claim line, 888.59 feet to the point of
beginning. EXCEPTING THEREFROM that portion conveyed to Jackson
County, a political subdivision of the State of Oregon by deed
recorded May 18, 1988 as No. 88-09377, of the Official Records of
Jackson County, Oregon.
