HomeMy WebLinkAbout1984-004 B&G Properties Agrmt.$4.-0 .040 AGREEMENT THIS AGREEMENT entered into this ./~.~ day of January, 1984, between B & G PROPERTIES, INC., an Oregon corporation (hereinafter called "B & G"), and the CITY OF ASHLAND, a municipal corporation of the state of Oregon (hereinafter called "City"), RECITALS: A. B & G owns the real property described in Exhibit A attached[ to and made a part of this aareement. B. B & G is in the process of plotting a subdivision to be known as "Oak Knoll Meadows" upon the property described in Exhibit A. C. The City owns and operates a small airport approximately six-tenths (.06) of a mile north of the property described in Exhibit A. D. Crowson Road abutts the Oak Knoll Meadows subdivision along its southeasterly property line which road may be developed at a future date. E. The City, as a condition to approving the plat, requires that the sale by B & G property of lots and any property in Oak Knoll Meadows be subject to the conditions hereinafter set forth. 1 - Agreement Return to: City Recorder 20 E. Ashland, Or. 97520 84---0X040 Crowson Road Ail lots and properties sold by B & G and Oak Knoll Meadows shall be subject to the condition that the grantees (whether singular or plural) covenant and agree that they shall and do hereby consent and request the City to form a Local Improvement District (LID) for the express purpose of improving Crowson Road. Such improvements may include widening and paving the travelway, the construction of curbs, gutters, sidewalks, storm sewers and the installation of street lights. The present and future owners of the property within the Oak Knoll Meadows development shall and do agree to future improvements and shall further agree to pay the fair proportionate share of the cost thereof as determined by the city council for the City and not to protest the future formation of a LID designed to implement such improvements all to be undertaken and the LID formed at such time as the City of Ashland shall determine in its discretion with such date to be no later than thirty (30) years from the date of this Agreement. The covenants, conditions and agreements herein contained shall operate as covenants running with the land and shall ibe binding upon B & G, its successors and assigns, and all future owners of property within Oak Knoll Meadows for the respective periods hereinabove set forth. 3 - Agreement 84.-.O1040 The City hereby approves the foregoing as a part of the requirements placed upon B & G in its application for the Planned Unit Development Use Permit.
