AGREEMENT
Carl Borgstrom, the owner of 616 Fordyce Street, in exchange for
water service being furnished to said property by the City of Ashland,
does agree as follows:
1. As the owner of the hereinafter described real property,
he agrees to irrevocably consent to the annexation of said land to the
City of Ashland at any time selected by the City of Ashland, and at that
time to pay to the City an annexation fee of $.0383 per square foot.
2. That in the event a court of competent jurisdiction holds
that the City of Ashland was or is without authority to furnish water to
said property, that in that event, he will immediately permit his property
to be disconnected from the City water system, and to hold the City of
Ashland, its employees, officers and agents harmless from any loss what-
soever, and of any type whatsoever.
3. That this Agreement does touch and concern the land, and is
to run with the land so as to be binding on the present owner, his successors,
heirs and assigns.
4. Said land is located in the State of Oregon, County of
Jackson, more particularly described as follows:
Said legal description is contained in Exhibit A, which
is attached hereto and incorporated herein.

EXHIBIT A tO AGREEMENT by CARL BORGSTROM
Beginning at a point on the East line,:of Donation Land Claim No. 43 in
Township 39 South, Range 1 East of the Willamette Meridian in Jackson
County, Oregon, said point being 270.26 feet North 0° 11' East from the
intersection of said Claim line with the Northerly line of the County
Road (now East Main Street extended) ; thence North 0° 1i' East along
said Claim line 180.56 feet; thence West 482.50 feet to the East line
of Fordyce Street; thence South along said street line 180.56 feet;
thence East 482.50 feet to the point of beginning.
