Re: Sanitary Sewer Easement
Dear Mr. Ulrich and Ms. Nordtvedt:
It is the intent of this letter to set forth the conditions and im-
provements to be completed by the City of Ashland as consideration
for an easement for sanitary sewer purposes across your property.
The City of Ashland agrees that the following improvements will be
made and the conditions, as listed, will be adhered to:
The City will cause to be constructed a driveway between Helman
Street and the existing residence at 520 Helman Street. The con-
struction will include the removal of blackberry vines, brush and
debris in the area of construction. A twenty-eight (28) foot wide
curb opening will be provided at Helman Street. The drive will
be surfaced with approximately three (3) inches of 3/4 inch minus
crushed rock, approximately twelve (12) feet in width.

Any areas of construction within the owners existing lawn shall
be reshaped and reseeded to the owners satisfaction.

The contractor will be required to cover and barricade all open
trenches within the owners property at all times when actual con-
struction is not in progress.
I believe all items mentioned in our previous conversation have been
covered. If you are in agreement with these terms and conditions as
listed, please indicate your approval by signing in the space provided
below.
We appreciate your assistance in the improvement of our sanitary sewer
collection system. We feel that the new construction will greatly
benefit the neighborhood by preventing hazardous sewer line overloading.

EASEMENT
KNOW ALL MEN BY' THESE PRESENTS:
That Stephen F. Ulrich, Lora L. Nordtvedt, and Citizens Financial
Services Inc. do hereby grant an Easement unto the CITY OF ASHLAND, a
Municipal corporation of the State of Oregon, for and in consideration of
one dollar and other good and valuable consideration, which Easement is
for the installation and maintenance of a sewer line and its facilities;
and which Easement is over the property situated in Jackson County, Oregon,
described as follows, to-wit:
A strip or parcel of land 15.00 feet in width lying 7.50 feet on each
side of the following described center line:
Commencing at a 2-inch iron pipe with a 3-inch brass cap monumenting
the Northeast corner of Donation Land Claim Number 40, in Township
39 South, Range 1 East of the Willamette Base and Meridian, Jackson
County, Oregon, thence South 06o40'45.5`' West, 1025.54 feet to the
center of a manhole cover situated on the centerline of an existing
sanitary sewer; thence along said sewer line North 03o25'45'' East,
8~00 feet to the True Point of Beginning; thence North 46o38'48'' West,
91.57 feet to the Easterly right of way line of Helman Street as shown
by recorded survey number 6753 dated March 31, 1977, filed in the
Jackson County Surveyors Office for the terminus of this easement, the
Northerly and Southerly side lines thereof shall be lengthened or
shortened to close upon said Easterly right of way.

The Grantors warrant that they are the owners of said real property free
and clear of all liens and encumbrances whatsoever, except those of record
on the below date.
