Paul Steinbrenner County Administrator PS/cf Enclosure SETTLEMENT AGREEMENT This agreement made and entered into and effective this _,~r day of Xi~~-~.~.4_, 198z~, by and between Jackson County, Oregon, a municipal corporation by and through its Board of County Commissioners, all hereinafter referred to as "County," and the following local government in Jackson County, Oregon: ~being a ~aunicipal corporation an~ .ereina ter referred to as "Local Government." WHEREAS, Local Government has asserted claim against County pursuant to the 1983 memorandum opinion in School District No. l'v. Multnomah County, et 9~, Case No. 1762 in the Oregon Tax Court, and WHEREAS, County and Local Government have determined to resolve and fully settle the matter in the manner hereinafter provided. It is hereby agreed as follows: 1. The County will: a. Pay and apportion to the above-described Local Government the escrow fund in which the County has maintained separately all interest and earnings on the unsegregated tax account beginning with the apportioned pursuant to attached Exhibit "A". The present balance of the fund as of November 30, 1985, is $335,690.87. The money in the escrow fund has itself accrued interest and the fund includes the accrued interest. b. Will continue to distribute to Local Government its share of the interest as it thereafter accrues I - SETTLEMENT AGREEMENT on the unsegregated tax account pursuant to the applicable schedules prescribed by ORS 311.390. c. Pay and apportion to Local Government an amount equal to its share of the interest accrued in the unsegregated tax 'account attributable to 1982-83 taxes. This amount will be paid in three equal installments; in January, 1985; December, 1985; and Dece~her~ i9~6~ ~tt~ch~d ~s !~c~ed~!ie ~'~ representing the distribution attributable to' 1982-83. 2. Local Government: a. Accepts this in full discharge of its above-described claim to this date; and b. Agrees that if the 1985 Legislature enacts legislation which limits the County's liability for interest accrued and accruing on its unsegregated tax account and the same is adjudicated to be valid by a court of competent jurisdiction in a proceeding instituted by any party hereto within 120 days ef the effective date of such legislation, Local Government will repay the County the money paid under this agreement in excess of the amount so limited; and c. Agree that if an appellate court decides contrary to the above-cited memorandum decision of the Tax Court as it relates to the issues here, the 2 - SETTLEMENT AGREEMENT money paid under this agreement contrary to the appellate court ~decision will be repaid the County.
