HomeMy WebLinkAbout1985-004 Easement - McDonald's~,.~.-02365 E A S E M E N T /V;¥,~ %°' KNOW ALL MEN BY THESE PRESENTS that the MCDONALD'S CORPORATION(Grantor) does hereby grant an Easement unto the CITY OF ASHLAND, a Municipal corpora- tion of the State of Oregon, for and in consideration of one dollar ($1.00) and other good and valuable consideration which Easement is for installation and maintenance of public utilities and their related appurtenances and which easement is over the property situated in Jackson County, Oregon, described as follows, to-wit: A strip of land !0 feet in width lying 5 feet on each side of the following described centerline: Commencing at the Section Corner common to Sections 11, 12, 13 and 14 located in Township 39 South Range 1 East of the Willamette Meridian, Jackson County, Oregon, thence North 49.45 feet and West 3863.61 feet to a found 5/8 inch iron pin monumenting the Southeast corner of parcel number 1 as shown on that minor land partition map filed for record on the 28th day of September, 1981 and recorded in Volume 4 page 68 of "l~inor Land Partitions" in Jackson County, Oregon; thence along the Easterly line of said parcel, North 00042'02'' West, 18.15 feet to the True Point of Beginning; thence leaving said easterly line North 84o23'46'' West, 11.66 feet; thence along a 52.46 foot radius curve to ghe right (the long chord of which bears North 46o17'49'' West, 53.22 feet) 57.35 feet; thence North 08o11'35'' West, 92.36 feet; thence along a 29.44 foot radius curve to the left (the long chord of which bears North 36o42'57'' West, 28.11 feet) 29.31 feet; thence North 65o14'36'' West, 38.06 feet; thence North, 16.00 feet; thence South 86o25'48'' West, 23.21 feet to the Westerly line of said parcel; thence North 86o25'48'' East 110.30 feet to the Easterly line of said parcel for the terminus of this easement. All ease- ment side lines shall be shortened or extended as required, to close upon the said boundary lines of this parcel. AGR~ AND CONSENTED TO: ~ ~/j/Lyl; Hill 85.-023~5 Exhibit A In the event that this easement ceases to be used by the City of Ashland for utility purposes, it shall revert to the Grantor. The City of Ashland shall repair and restore the easement premises to a condition equivalent to that which existed prior to the City of Ashland performing any work on the premises.
