The right to the use of this water is regulated and ~l~ay be temporarily or permanently terminated pursuant to the provisions of Ashland City 'Ordinance No. 2188 and as it ma)' be amended in the future. The land involved is located at 320 Scenic in the City of Ash]and, County of Jackson, State of Oregon, more particularly described as follows: a tract or parcel of land situated in Government ~ot 4, Section 5, Township 39 South, Range 1 East, Willamette Meridian, Jackson County, Oregon, and being more fully described as follows: STATh Ot-: OREGON ) Count)' of Jackson) Commencing at a 1" square iron bar, situated at the intersection of the center line of Wimer Street, with the West boundary line of Donation Land Claim No. 40, Township 39 South, Range 1 East, Willamette MEridian, Jackson County, Oregon; thence South 00~ 04' 43" West, along the West boundary line, of said claim, 457.60 feet, to a 5/8" iron pin; thence leaving said claim line, South 89" 55' 44" West, 20.00 feet, to a 5/8" iron pin, situated on the Westerly right of way of High Street; thence continue South 89~ 55' 44" West, along that boundary line described in Document No. 75-12988, Official Records of Jackson County, Oregon, 283.50 feet to a 5/8" iron pin at the Northwest corner of that tract described as Document No. 75-12990, said Official Records and the True Point of Beginning; thence continue South 89" 55' 44" West, along said boundary line described in Document No. 75-12988, said Official Records and along boundary line described in Document No. 75-12987, said Official Records, 264.51 feet, more or less, to the Easterly line of Scenic Drive; thence South 00~ 27' 54" East, along said Easterly line, 114.905 feet, more or less, to a point on that boundary line described in Document No. 75-12599, said Official Records; thence South 89~ 55' 30" East, along said boundary line, 263.42 feet, more or less, to a 5/8" iron pin at the Southwest corner of tract described in Document No. 75-12990, said Official Records; thence North 00~ 04' 43" East, along the West line of said tract, 115.575 feet to the True Point of Beginning. The owners or coutract purchasers are the persons who have signed this document and they agree to the terms of the above referenced ordinance and as it ma)' be amended in the future.
