hereinafter referred to as the Cooperating Agency, is entered into under
the authority of the Job Training Partnership Act (JTPA) of 1982 (Public
Law 97-300).
Whereas, the Cooperating Agency is interested in accepting support for
activities and providing meaningful work experience, training and supervision
to participants, it is agreed and understood that;
THE JOB COUNCIL WILL:
Be responsible for recruitment of eligible enrollees and completion
of all required enrollment forms.
Refer available enrollees to the Cooperating Agency, upon its request,
for assignment to bonafide work stations. The number of enrollees
so referred is to be controlled by The Job Council.
Provide necessary counseling and services to participants during the
work experience program.
4. Monitor worksites in accordance with state and local policy.
Provide orientation to the JTPA program for immediate worksite supervisors
and designated backup supervisors of the cooperating agency as to
their duties and responsibilities to the participants and program.
Provide all payroll functions and issue checks for each participant.
Make all appropriate tax deductions and issue a W-2 form to each parti-
cipant at the end of the year.
Provide insurance as required by law for on-the-job injuries suffered
by participants while engaged in duties assigned by the Cooperating
Agency.

The Job Council will reimburse the Cooperating Agency such costs as
approved in the project budget upon receipt of invoice complete with
source documentation.
The source documentation needed by The Job Council for reimbursement
of:
Wage/Fringe:
Timesheets and/or paycard; fringe must be broken
out such as FICA, SAIF...
Supplies: Paid Invoices
Transportation:Paid Invoices
The invoice must be signed by the Cooperating Agency representative
as per Summer Youth Work Experience Project contract.
The Job Council will reimburse the Cooperating Agency for invoices
submitted by the fifth (5th) or fifteenth (15th) day, on the eleventh
(llth) and/or twenty-sixth (26th) day of the month, respectively.
THE COOPERATING AGENCY WILL:
'1. Training and Supervision
Provide meaningful work experience and training, giving instruction
to the participant in all phases of the work to be performed
in order to give them the greatest benefits from the Work Experience.
Be responsible for expenses incurred in supervising or training
participants other than those expenses The Job Council has specif-
ically agreed to pay.
Provide adequate supervision, including substitute supervisors
if necessary, for each participant. At least one (1) supervisor
for each ten (10) participants is required. Notify The Job Council
within 72 hours of supervisory changes so that adequate orientation
can be provided.
Notify The Job Council within twenty-four (24) hours of any on-the-
job injury or occupational illness involving any work experience
participants. If the Cooperating Agency fails to notify The
Job Council within the required period, the Cooperating Agency
shall hold The Job Council harmless from any liability, cost
or expense (including attorney fees) resulting from any delay
caused by the act of notice of such injury or illness.
Provide sufficient equipment and/or materials to carry out training
assignment and assure that adequate work assignments are provided
to fully utilize participant's training hours.

Training Hours and Time Records
Maintain participant training hours that will be during the normal
working hours of the Cooperating Agency and will be in compliance
with Child Labor Laws. The hours may not exceed 40 hours in
any one week.

Keep an accurate daily record of time worked by the participants,
using time report forms provided by The Job Council, and submit
those time records to The Job Council by the 1st and 16th of
each month.
Report only actual time on the job and special excused absences
authorized by The Job Council in writing. There is no sick leave,
vacation, overtime, or holiday pay authorized under JTPA. Coo-
rdinate working hours with other training activities as scheduled
by The Job Council.
Submit to The Job Council, as requested, reports indicating staff
time spent in supervising and/or counseling participants and
the problems and progress of each participant.
3. Personnel Actions
Provide participant trainees with a reasonable opportunity to
correct or improve performance, progress or conduct (unless the
matter requires immediate discharge) after a performance problem
has been discussed with the trainee.
Clearly explain performance standards and worksite policies to
the trainee at the earliest opportunity of the worksite supervisor,
but not later than the participant's third workday.
Notify The Job Council representative about any problems regarding
the participant, such as tardiness, absenteeism, insubordination,
poor attitude, etc.
Training Limitations
Place participants only in worksites that have safe and healthful
working conditions and insure that no participants under 18 years
of age are placed in working conditions declared to be hazardous
by State or Federal Regulations.
Employ participants only in publicly owned facilities, projects
or on local projects sponsored by private non-profit agencies
or organizations, assuring that no trainee will be employed in
a project involving operation, construction, or maintenance of
a facility used or to be used for sectarian instruction or a
place of religious worship.

c. Not allow participants to engage in any union activities.
Obtain written concurrence from the appropriate bargaining age, nt
where the Cooperating Agency has a collective bargaining agreement
covering occupations in which training is proposed. Such concurrence
must apply to those issues which effect the bargaining agreement,
such as wages and benefits. If no response is received within
thirty (30) days, it is assumed that the bargaining agent concurs
and training may proceed.
Assure that participants will not be trained during times of
work stoppage due to labor disputes.
Assure that no funds under this agreement will be used to assist
political activities.
5. Maintenance of Effort
Not utilize participants in a manner that will result in:
(1) the displacement of currently employed workers, including
partial displacement, such as reduction in hours of non-
overtime work, wages, or employer benefits.
(2) impairment of existing contracts for services or result
in the substitution of JTPA funds for other funds in
connection with work that would otherwise be performed,
including services normally provided by temporary, part-
time or seasonal workers or through contracting such services
out.
(3) replacing an individual on layoff from the same or substantially
equivalent job.
(4) a position created that will infringe in any way on the
promotional opportunities of any currently employed individual.
(Positions should supplement, not supplant existing positions).
(5) replacing a regular employee who was terminated in expectation
of receiving JTPA funds.
6. Special Provisions
Assume financial responsibility for damages to property
and/or injuries to third parties which may be caused by
trainees while operating equipment or otherwise being trained
by the Cooperating Agency while on or off the property of
the Cooperating Agency.
Comply with the Job Training Partnership Act and its regulations
for activities supported under this agreement.
c. Remain in compliance with all child labor laws.
Allow The Job Council staff to visit the worksite to review
training performance and to ensure compliance with this
agreement.

7. Fiscal Provisions
The Job Council will reimburse the Cooperating Agency such
costs as approved in the Project Budget upon receipt of
invoices complete with source documentation.
The invoice submitted by the Cooperating Agency must be
signed by the Cooperating Agency representative as identified
on the Summer Youth Work Experience Project contract.
The Cooperating Agency will bill The Job Council separately
for each project budget.
The Cooperating Agency will submit total project expenditure
invoices to The Job Council by October 31, 1985.
This agreement may be terminated by either party by written notification.

PROJECT BUDGET
The Agreement amounts contained herein are the maximum allowable under
this Agreement. The Agency shall comply with the budget forms in all
particulars. Changes in the budget Agreement amounts must be in writing
and approved by both parties. '
