It is recognized that the hereinafter described land
uses or is permitted to use Talent Irrigation District irrigation
water from t}:e. City of Ashland. The right to the use of this
wate: is regulated and may be temporari].y or permanently terminated
purs~ant to the provisions of Ashland C.i. ty Ordinance No. 2188
and as it may be amended in the future. The land involved is

This agreement is to run with the land and to be binding
on the heirs, successors and assigns of the undersigned.

LAND DESCRIPTION
A tract or parcel of land situated in the Northwest quarter of the Southeast quarter
of Section 5, Township 39 South, Range 1 East of the Willamette Base and Meridian,
Jackson County, Oregon and being more fully described as follows:
Commencing at the centerline intersection of Chestnut Street with Luna Vista Street,
said point bears South 3,738.56 feet and East 549~91 feet from the North quarter
corner of said Section 5; thence South 89°36'30" West along the centerline of Luna
Vista Street, 187.85 feet to a point which bears North 00°04'10'' West, 43.5 feet
from the Initial Point of Mann Subdivision to the City of Ashland, Jackson County,
Oregon, as now recorded; thence leaving said street centerline, South O0°04'lO"East,
20.00 feet to a point in the Southerly right of way line of Luna Vista Street
which is common to the Northeast corner of Mann Subdivision, as hereinabove referred
to, said point being the TRUE POINT OF BEGINNING; thence leaving said subdivision
boundary line, North 89o36'30'' East along the Southerly right of way line of Luna
Vista Street, 160.41 feet to an intersection with the Westerly right of way line
of Chestnut Street; thence South 00o14'35'' East along said Westerly right of way
line, 45.11 feet to an angle point in said right of way line; thence South 41o53'
40" East along the Southwesterly right of way line of Chestnut Street, 115.39 feet
to a point which bears South 89055'50'' West, 26.84 feet from a 5/8 x 30 inch iron
pin with aluminum cap situated in the centerline of Chestnut Street; thence leaving
said right of way line, South 89°55'50'' West, 237.49 feet to a point in the Easterly
boundary line of the Mann Subdivision, as hereinabove set forth; thence North O0°
04'10" West along said Easterly boundary line, 130.19 feet to the point of beginning.
Containing 0.557 Acre, more or less.
Subject to any and/or easements and/or rights of way of record and those 'apparent
on the land.
