AND USE AGREEMENT AND MODIFICATION
OF DEED RESTRICTIONS
The parties to this agreement are the Ashland Family YMCA;
the Ashland Parks and Recreation Commission; and the City of
Ashland, Oregon.
Whereas, the parties entered into a Maintenance and Use
Agreement dated October 3, 1986 and recorded October 6, 1986 as
Document No. 86-19956 of the Official Records of Jackson County,
Oregon; and
Whereas, said agreement sets forth covenants which encumber
the title to real property conveyed by a Bargain and Sale Deed
dated October 6, 1986 and recorded October 6, 1986 as Document
No. 86-19956 of the Official Records of Jackson County, Oregon
wherein the Young Men's Christian Association of Ashland, Oregon
is Grantor and the City of Ashland, Oregon is Grantee; and
Whereas, it is the intention of the parties to delete
paragraph 12 on page 5 of that agreement.;
NOW, therefore the parties agree as follows:
1. Paragraph 12 on page 5 of said agreement is deleted.
2. Said agreement is ratified in all other respects.
3. Said deed restrictions are modified by the terms of this
agreement and ratified in all respects not modified by this
agreement.
