In order for grant funds to be released, we need to have the two enclosed copies of this Agreenmnt signed by the authorized officials and returned to this office. A fully executed copy will be returned to you. AGRMM~ Execution of this document by authorized officers constitutes a mutual Agree- nmnt between the Oregon Arts Cc~luission, hereinafter referred to as "CC~4MISSION", and City of ,%s.hl~n~v/A~b~and Ourmlmity Ctr~ hereinafter referred to as "APPLICANT". This Agreement is' based upon application number t.~386-370 , which is by reference adopted herein. Upon receipt of this do~t, the Conmission agrees to release all, or a portion, of $_!r500.00 in approved project funds to the APPLICANT follow- ing the start of the project. Funds are to be disbursed according to the pay- ment schedule indicated belc~ by the APPLICANT. The APPLICANT'S assurances are a part of the consideration for and are relied upon in connection with all financial assistance given by the National Endow/feint for the Arts and the Oregon Arts Conmission. The State of Oregon and the United States shall have the right to seek judicial enforcement of these assurances, which are binding on the APPLICANT, its successors, transferees, and assignees, and on the authorized official whose signature appears below. The APPLICANT warrants and assures that: It possesses legal authority to accept the grant. A resolution, motion, or similar action has been duly adopted by the APPLICANT'S governing body, authorizing the application and identifying an official authorized to act in connection with the application. -2- o Funds paid by the ~SSION shall be expended according to authorized purposes, wage levels, audit requirements, and limitations, on the matching basis as provided in the approved budget sunmary. Amended budgets shall require the approval of the ~SSION. No person shall, on the basis of race, color, creed, religion, national origin, sex, or handicap be denied the benefits of, or otherwise be sub- jected to discrimination under any program or activity receiving Federal or State financial assistance. The APPLICANT will therefore, comply with: - Title VI of the Civil Rights Act of 1964 (42 U.S.C. 2000d et. seq.). - Section 504 of the Rehabilitation Act of 1973 (29 U.S.C. 794) as amended. - Title IX of the Education Amendments of 1972 (20 U.S.C. 1681 etc. seq. ) , where applicable. - All regulations of the National Endowment for the Arts and the Oregon Arts Commission issued pursuant to these statutes. 4. All regulations and guidelines applicable to acceptance and use of Federal or State funds for the approved project will be obeyed. All records required by the audit guidelines shall be kept and retained for three years. Such records shall be available to the COMMISSION, its authorized agents, or auditors upon request. All publicity, visual or oral, for this project shall be accompanied by: "This project is made possible by a grant from the Oregon Arts Conmission and by the National Endovanemt for the Arts". The APPLICANT will be obligated by these assurances for the period during which Federal or State financial assistance is extended, with two exceptions: so If any personal property is acquired with National Endowment for the Arts/Oregon Arts Conmission assistance, the APPLICANT will be obligated for the period during which it retains ownership or possession of that property. If any real property or structure is improved with National Endowment for the Arts/Oregon Arts Conmission assistance, the APPLICANT shall be obligated for as long as the property .or structure is used by the grantee, its successors or assignees. -3- Payment Schedule: The APPLICANT requests that funds be disbursed, all or in part, on the follc~ing basis: JULY JA~JARY AUGUST FEBRUARY SEPTEMBER MARCH OCTOBER APRIL NOVEMBER MAY DE~ER JllqE OREG(1N ARTS COMMISSION By Leslie Alexander Assistant Director Acknowledge and agree to this date: ~'~'~~-~ / 53//~' ~gi~f' This grant is made possible by funds appropriated to the Oregon Arts Cc~mission by the Oregon State Legislature. Attached is a listing of the 1985 Legislative Assembly, including addresses and telephone numbers. We encourage you to noti[y your Legislators as to the arts projects these funds support, and to invite these same Legislators to attend.
