KNOW ALL MEN BY THESE PRESENTS:
That Herman H. Schmeling and Sylvia A. Schmeling
do hereby grant an Easement unto the CITY OF ASHLAND, a Municipal corporation
of the State of Oregon, for and in consideration of other good and valuable
consideration which Easement is for installation and maintenance
of a sanitary sewer line and related appurtenances,
and which Easement is over the property situated in Jackson County, Oregon,
described as follows, to-wit:
An easement 10 feet in width lying 5 feet on each side of the following
described centerline:
Commencing at the Northwest corner of Donation Land Claim Number 44, Town-
ship 39 South, Range 1 East of the Willamette Meridian, Jackson County,
Oregon; thence South 1534.74 feet and West 510.24 feet to a found 5/8 inch
iron pin monumenting the center line of Fordyce Street at the northerly
terminus of its right of way; thence along said northerly line South
89°48'41'' East, 3.83 feet for the. True Point of Beginning; thence
North 07059'27'' West, 98.02 feet; thenc~ North 02024'47'' East, 300.00 feet
to an existing manhole for the terminus of this easement.
The side lines of which shall be extended and/or shortened to close upon
said right of way.

The Grantors warrant that they are the owners of said real
property free and clear of all liens and encumbrances whatsoever, except
those of record on the below date.

Dear Mr. & Mrs. Schmeling:
Enclosed is the instrument for creation of an easement for the
construction and maintenance of a sanitary sewer pipeline across your
property at 492 Fordyce Street.
Consideration for granting the easement shall be one 4" sanitary
sewer connection onto the City system subject to usage by the resi-
dence located on tax lot no. 391E 10B 2002. The consideration offered
will be in lieu of the standard sewer connection fee charged for sewer
connection by residences outside the City Limits.
If you have any questions as to the actual location of the sewer
line or to the terms of the easement, please feel free to call at
482-3211 ext. 258. We have tried to position the sewer line so as to
provide the least amount of disturbance to your property as possible,
and of course the area will be restored to near original condition
upon completion of the project.
If the easement form is acceptable to you, would you please sign
and return it at your earliest convenience. Please note that the
signatures do require a notaries' seal. Several members of the City
Planning and Engineering staff are notaries and would gladly offer
their services at no charge. A stamped, self-addressed envelope is
enclosed to facilitate your return of the instrument.
