HomeMy WebLinkAbout1983-011 Agrmt - Rhoda Allen A G R E E M E N T THIS AGREE~ENT made and entered into this /.~day of February, 1983, by and between the CITY OF ASHLAND, a Municipal Corporation, hereinafter called "City", and RHODA D. ALLEN, hereinafter called "Allen": WITNESSETH: RECITALS: 1. Allen is the owner and operator of certain rental units doing business under the name of Jessel Cottages at 278 Idaho, Ashland, Oregon. 2. Allen plans on terminating the rental units within two (2) years and has agreed not to ask for an extention on this agreement. 3. Allen is experiencing difficulty in the use of electricity by her tenants and, thus, wishes to have permission to charge the tenants for the use fo the electricity at a rate not to exceed the City's charges to her. NOW, THEREFORE, in consideration of the foregoing recitals the truth of which is hereby acknowledged and of the mutual covenants con- tained herein it is agreed by and between the parties hereto as follows: I Determine this agreement is for three (3) years from its date. II Allen is hereby given permission to charge tenants for the use of electricity at a rate not to exceed to City's charges. III it is further agreed that if there are any complaints from the tenants with respect to this practice, then this will be grounds for the termination of this agreement and the discontinuance of Allen's right to charge for electricity.
