Update - Mutual Assistance Agreement
Ail of the participating agencies in the current mutual
assistance agreement have, because of newly formed fire
protection agencies, decided to update the agreement and
provide for these new agencies to join. The current
agreement required that when a new agency wishes to join,
the agreement has to go to each of the participating agencies
for their approval; a very time consuming process.
This new agreement allows the addition of newly organized
agencies from time to time. The agency must first be
recommended for addition by the Rogue Fire Chiefs Assoc.
and be approved by the chief executive officer of each of
the existing parties. Any additions are made by attachment
to this new agreement.
I will be attending the council meeting in case of questions
regarding this agreement.

Dear Chief:
Enclosed is a copy of the newly updated Mutual Assistance Agreement,
which has been drafted in committee and approved by the Rogue Valley
Fire Chiefs Association. This copy is for your executive officers to
review and prepare themselves for signing the official document being
'held by the City of Central Point. It is desired that all signatures
be obtained by December 15, 1983. Upon completion of the signatures on
the official document, each agreeing party will receive a copy for your
records.
Each agreeing party must have their chief executive officer sign the
agreement and an authorized witness attest that signature. The official
document will not be left with any agency, but will be hand-delivered
for immediate signatures if necessary. If it is at all possible, the
signing of the document at the Central Point City Hall, Fire Chief's
office, would expedite the process.

· WHEREAS, the parties hereto recognize the real likelihood that fires or
other like disasters hereafter occurring in their respective territories could
reach such proportions that it would be impossible to control them with local
equipment and personnel, and to facilitate and comply with the 1983 Oregon State
Fire Service Plan as directed by Executive Order No. E0-83-12 under ORS 476.519
to 476.610 of the Oregon State Emergency Conflagration Act, and it is,necessary
and proper that a Mutual Assistance Agreement be entered into by the undersigned
for the mutual protection of life and property, and,
IN CONSIDERATION of the covenants herein contained, each of the under-
signed agrees to furnish firefighting equiF, ment and personnel to any of the other
undersigned, when-assistance is necessary and men and equipment are available,
and to receive and transmit such calls as may be received from the police or fire
departments of any and all of the undersigned when authorized by, and transmitted
in accordance with, the regulations of the Federal Communication Commission; pro-
vide~, however, that no party hereto shall be liable for any failure, commission,
or omission in' connection with the receiving or transmission of such calls. It .
is agreed that none of the parties hereto shall be liable to any other party for
damage to property, loss of equipment, or injury to personnel, or for the payment
of any compensation whatsoever, arising in the course of, or as a result of, any
assistance or lack of assistance rendered under the terms of this agreement.
(This provision is not 'intended to waive the legal rights of any individual.) It
is further agreed that newly organized fire protection agencies may be added as
parties from time to time. Such agencies shall first be recommended for addition
by the Rogue Valley Fire Chiefs Association and be approved by the chief executive
officer of each of the existing parties. Any additions shall be made by means of
attachment to the agreement herein with copies of such attachment made available
to each agreeing agency. The administrative heads of the fire departments of the
parties to this agreement are authorized and directed to meet and draft such Rules
of Procedure as shall best accomplish the purpose of this agreement. Any party
may withdraw from tile entirety or attachments hereto of this agreement by giving
30 days written notice of its intent to withdraw to tile other parties.
