This agreement is entered into among and between the undersigned parties for the purpose
of securing to each the benefits of automatic response to alarms, secondary back-up capa-
bility, and overall better utilization of personnel and equipment in fire protection and
prevention, rescue, civil disorder or any other type of emergency or disaster.
IT IS AGREED THAT:
1, Each of the parties undersigned shall furnish to any of the other parties undersigned
pre-programmed and pre-arranged automatic assistance. Additional pre-arranged assistance
may be called for by the person in charge of emergency operations in the district or area
where such ~m~vncy occurs
2. The amount of men and equipment that shall be dispatched from one agency to assist
another, shall not exceed (in the opinion of the fire chief of the agency sending aid or
of the commanding officer than on duty) the ability of the agency to send aid and still
retain a reasonable degree of protection for their political jurisdiction.
S. Each party agrees to inform the Central Communications Center immediately when appara-
tus or equipment is placed in an out. of-service condition so that substitutions may be ~ade
to ensure the effectiveness of the program.
4. It is hereby expressly agreed and understood that any such assistance given under orders
of the "Oregon State Emergency Conflagration Act" or upon the Governor declaring a state of
extreme emergency or state of disaster, shall not be governed by this agreement.
S. When men and apparatus or equipment are furnished pursuant to this agreement, the per-
son in charge of emergency operations at the scene of the incident shall be from the ,organi-
zation having primary responsibility or jurisdiction. He shall have complete control and
supervision over all equipment personnel during the duration of the emergency. In the
event that the chief or commanding officer of the district or area where such emergency
occurs shall not have arrived at the scene, the chief or commanding officer of the party
rendering aid shall be in command until the arrival of the chief or commanding officer of
the party receiving automatic aid. During such time as he may temporarily be in command,
such officer shall exercise all lawful authority of the chief of such district or city.
6. Each party waives all claims against every other party for compensation, for services,
loss, damage, personal injury, or death occurring as a consequence of the performance of
this agreement.
7. The signatures to this agreement agree through their respective departments to cooper-
ate in establishing a move-up system of fire apparatus so that the best possible continuous
coverage of fire stations can be achieved.
8. Minimum requirements of manpower and equipment to be maintained by any party to this
agreement shall be fixed and adopted by the Fire Chiefs of the parties to this agreement.
Such standards shall be periodically reviewed and modified to meet the challenges presented
by future growth and development.
9. Continued failure by any party to meet the requirements established, shall be consid-
ered to be just cause for cancellation of this agreement by the other parties to the
agreement.
