AN ORDINANCE VACATING AN ALI.El IN THE CITY OF ASHLAND, OREGON, RUNNING SOUTHERLY FROM LAUREL STREET, A DISTANCE OF 200.75 FEET. WHEREAS, a petition representing all abutting owners and 94.5% of the owners in the affected area of the alley pro- posed for vacation, was filed in accord with ORS 271.080; and WHEREAS, Notice of a public hearing on the proposed vacation of the subject alley was duly given in accord with ORS 271.110; and WHEREAS, a public ]nearing was held on April 20, 1982, at which time written and oral co~mnents were solicited by the City. Council, at which public hearing no protests were received by Council to the vacation of said alley. NOW THEREFORE, THE PEOPLE OF THE CITY OF ASHLAND DO ORDAIN AS FOLLOWS: SECTION 1. It is hereby determined that the public interest will 5-~-~est served by the vacation of the alley located in the City of Ashland, Jackson County, Oregon~ and more particularly described. as follows: A portion of that 16-foot wide alley.situated in Block 25 of the City of Ashland, Jackson County, Oregon, according to the official plat thereof adopted by the City Council on Novem- ber 5, 1888, adjoining Lots 1, 2, 5, and 6 of said Block 25. ~ECIION 2. That easements for public utilities within the above described alley to be vacated, are hereby reserved to the City of Ashland as follows: Reserving an easement for the perpetual mainten- ance of all existing utility lines and facilities currently in place in the a~ove described alley, and for future public and private utilities which might become necessary. SECTION 3. For the foregoing reasons, the alley located on the land described above is hereby vacated, subject to reservation of the herein described public utility easements. SECTION 4. The City Recorder is hereby directed to forward copies of this Ordinance to the County Clerk, County Assessor, and County Surveyor of Jackson County, Oregon. 1- Ordinance The foregoing Ordinance was first read on the //~6 day of ~/~t~. , 1982, and duly PASSED and ADOPTED this./~ day of , Nan E.
