(The following information was accepted for publication nearly a month ago by the Ashland 'Daily Tidings. Then it silently died, without an iota of explanation to me despite my repeated queries. I suspect Drescher got to them. So I must now take to the streets. ) Allen (5. Drescher has experienced an epiphany. Ifyou sit in on a full session (day or evening) of the Ashland Municipal Court (AMC), you will be impressed with Judge Drescher's performance. Here is a convivial, attentive, considerate, fair-minde, d man; even occasionally jocular. I'd vote for him in a second! Unfortunately this person bears zero resemblance to the man who has presided over the AMC for the last 23 years. It appears that Drescher's epiphany is in reaction to the fact that for the first time in a dozen years his job is in jeopardy. The AMC oversees ali local non-criminal offenses; e.g., illegal camping, possession of less than an ounce of marijuana, littering, noise complaints, traffic tickets, graffiti, etc. Drescher is the first and only AMC judge we have ever had. He has generally outspent his opponents about two to one, but for the last 12 years has run unopposed, not bothering to even appear in the voter's pamphlet. His name is simply listed on the ballot, with no alternative. What a deal! There is good reason to believe his recent performance extends back quite some years. He has had a dozen complaints filed against him with the Oregon State Bar Association. Four of these were referred to the State Professional Responsibility Board, and one finally resulted in an official reprimand. The Oregon Committee on Judicial Fitness maintains extremely confidential records, to the extent that it refuses to reveal even how many complaints have been filed with them. When I moved to Ashland 6 years ago, I began to sit in on proceedings of the AMC, initially to get some sort of better fix on police/community relations. Superficially, the police here struck me as excellent. In every city I have lived this has been a major concern of mine, in that it so strongly impad:s the quality of life. While living in Portland, I had an official if brief liaison role, where I tried to facilitate aspects of the new Community Policing efforts, as well as expand the services of a pick up van for the Detox Center to include mental health aid for those mentally ill homeless who were continually getting into jams. I.E., this was the constructive alternative to simply throwing these people in jail. But the focus of my monitoring of AMC proceedings very quickly shifted to Drescher's behavior. Despite his often soft-spoken outwardly rational demeanor I perceived something vicious beneath. I have sat in on 5 full court sessions over these 6 years, widely spaced in time. Save for this most recent, election year, sampling, his performance has been wholly consistent. At his very best Drescher has a vaguely contemptuous morally superior air. At his worst he is grossly insulting, thoroughly vicious, and occasionally histrionic. At the technical level, he appears to confuse the principle of ignorantio £acti excusat with ignorantia legis neminem excusat. That is, he treats salient facts involved in a charge as; if they were ~rrelevant BECAUSE the defendant has, ostensibly, "broken the law". I'm sure if you asked Drescher, off the bench, he could recite the difference in these two over-riding legal principles. But in his frenzy to convict he cares not for this difference. I have seen him bring a young woman to the verge of tears with his relentless haranguing. I have seen him ruthlessly scorn a senior on disability, suffering depression and disorganized thoughts, and hold him up to courtroom ridicule by forcing him to sit on the raised dais facing the spectators until all other cases were heard. I have seen him wave his arms around over his head to indicate the extent of his power, intoning "I can call on the police from the entire State of Oregon to hunt you down!" I forget the context for this one - - - except that it was totally inappropriate. I have seen him accuse a man contesting a traffic violation (whose ticket I thought was unjust and prob- ably malicious) of "trying to weasel out of things". When the defendant shot back that this was clearly "projection" on his part, Drescher was brought up short. He muttered something about "contempt of court", and then totally lost it, ranting "DON'T TEST ME! DON'T TEST ME!". (I can well imagine some hapless visitor thinking "Crikey! All I did was jaywalk and I get Torquemada!") I have seen him banish a young man from out of state from the entire State of Oregon for five years, -- for buying some high school kids a six-pack. (over) The whole trick in evaluating Drescher as a candidate is to recognize that we're dealing with an actualJekyll & Hyde personality here; and Mr. Hyde should really be the dictator of a small totalitarian country. Drescher knows on which side his bread is but-tered and rubber-stamps all police actions. But there is a small minority of officers, lacking the judgment and character of their peers, who will always be over- represented in court proceedings, and Drescher simply encourages their cavalier behavior. Indeed, although he has never spoken the words, his attitude is made very clear: "If you're here, you're GUILTY. Ifyou will admit to this guilt I may go easy on you. Otherwise, I am going to make.you suffer". I have only seen him once find anyone innocent, and that was effectively taken out of his hands by higher authority. Drescher's feverishly advertised "innovative" and "creative" sentencing alternatives are in fact all flash and no substance. To begin with, his "diversionary" program, allowing reduced or no fine, is administered by clerks and serves merely to reduce Drescher's hours further. The net effect of all this "creativity" is nil. The: statistics for the last ten year's published by the Ashland Police Department (APD) can readily be translated to per capita incidences so as to eliminate the effects of population growth. If we look at all those reported offenses subject to trial by the AMC we find that there is absolutely ZERO change over this time. So much for Drescher's "effectiveness". But there is one exception. One of Drescher's "creative" innovations is to sentence youthful o-~enders from out of town to at least a year's banishment from the City of Ashland. Given especially that it is DRESCHER making them "outcasts", it does not take a Freud to predict what is going to happen: these kids are simply going to escalate things. The police statistics bear this out: there has been an average rate of increase in (per capita) vandalism of 3%/year, over the last ten years; i.e., it is now 30% mG~ER TUA~ n: WAS ZO ~^RS A~O. Additionally, it appears the scale of the damage inflicted has greatly increased. What makes all this especially insidious is that DRESCHER HAS .&BSOLUTELY NO ACCOUNTABILITY! NO transcripts are kept of AMC trial proceedings: thus none of Drescher's actual behavior in the courtroom can be reviewed by anyone - either public, or government. Drescher's verdicts & sentences CANNOT be appealed. Thus there can be NO review of the number of overturns by higher courts - which would otherwise provide a sobering corrective. A "mistrial" is the only basis for an appeal. This is usually quite technical and/or difficult to prove, and expensive. The ONLY records kept by the AMC are under the auspices of guess who? That's right: DRESCHER decides everything that goes into the records, how they are kept, and who gets to see what. The City is clueless. I once asked AMC clerks for a statistical breakdown of cases over the last 3 years. I was informed that this was incomprehensibly difficult, involving animal sacrifices to Amun-Ra and such, and so would cost at least $~00, and who knew when I would get it. In contrast, the APl> statistical breakdown of reported offenses for the last I__Q years was available on the spot for a mere $10. It is worth commenting that I once complained of AMC's record-keeping cabal to then-Mayor Shaw, the City Council, and City Administrator. I was told this would be reviewed; but it never was. I think this is really important: an independent accounting of SOME sort would tend to produce a corrective force to any judge's megalomania. As it is, Drescher has found himself an AmTmu~ sinecure at $~lk/year + benefits, where he gets to dump on people to his little heart's content, and has become a sad example of the corrupting influence of power. If the blocking of the Tidings publication of this information is due to Drescher, probably via threat of a lawsuit, then things are even worse than I dreamed. Let Drescher try to sue ME · I'd love il:!! It is time for Ashlanders to shake off their apathy, stop reading totally empty vapid endorsements, and get rid of this totalitarian creep.
