KNOW ALL MEN BY TttESE PRESENTS, that Edward A. Fallon and Esther Nell Fallon,
husband and wife, Grantors in consideration of four hundred fifty-five and no/lO0 ($455.00)
Dollars to them paid by the CITY OF ASHLAND, a municipal corporation of the State of
Oregon, Grantee, do hereby 8rant, bargain, sell and convey unto the said Grantee, its
successors and assigns, the water rights on 2.0 acres in the South half of Section 4,
Township 39 South, Rangc! East of the Willamette Mcrid~nn being further describe4 =c
follows:
Beginning at a point on the East side line of Oak Street in
the City of Ashland, Oregon, which is 66.6 feet East and
692.6 feet North 14o52' East from the Southwest corner of
Donation Land Claim No. 41 in Township 39 South, Range 1
East of the Willamette Meridian, Jackson County, Oregon;
thence North 14°52' East along the East side line of Oak
Street 144.8 feet to cor~r;~ thence East 829'feat~ the:nee
Southwesterly 364 feet, more or less to a point which is
544.5 feet East of the place of beginning; thence West 544.5
feet to the place of beginning, containing 2 acres, more or
less,
all within and part of that Certain water right situated in the County of Jackson and
State of Oregon, described as follows to-wit:
JOSEPH and KIZZIE MILLION, Ashland, Oregon, (Proof 179,
Vol. 4); Priority 1856; 0.63 second feet; for irrigation
of 50 acres; Million ditch; Description of place of use:
· 10 acres in NE 1/4 of SW 1/4; 5 acres in SE 1/4 of SW 1/4;
7 acres in NW 1/4 of SE 1/4; 8 acres in SW 1/4 of SE 1/4;
20 acres in SE 1/4 of SE 1/4 of Section 4, Township 39
South, Range 1 East of the Willamette Meridian, Jackson
County, Oregon.
To have and~to hold the above described water right unto the said Grantee, its successors
and assigns forever.
And the Grantors covenant that they are lawfully seized in fee simple of the
