HomeMy WebLinkAbout1992-06 Concerning ADARESOLUTION NO. 92- A RESOLUTION OF THE CITY OF ASHLAND, OREGON, CONCERNING THE AMERICANS WITH DISABILITIES ACT. WHEREAS, the Ashland City Council passed an equal employment opportunity- /affirmative action policy addressing all segments of the population, including the handicapped; and WHEREAS, recently the U.S. Congress passed the Americans with Disabilities Act (ADA) requiring organizations to take specific steps to assure they do not discriminate against those with a disability. NOW, THEREFORE, BE IT RESOLVED as follows: SECTION 1. The Ashland City Council intends that relevant provisions of the ADA and regulations issued pursuant to that Act be implemented where required. SECTION 2. To carry out the letter as well as the spirit of the City policy, the City Council appoints the Personnel Director as the ADA Officer. The ADA Officer will coordinate the City's efforts to comply with and carry out its responsibilities under the ADA and its regulations. SECTION 3. Complaints regarding allegations of non-compliance with, or alleging any actions prohibited by, the ADA or its regulations, shall first be taken up with the ADA Officer within thirty calendar days of the occurrence of the event leading to the complaint. The complaint shall be filed in writing and must include factual details, the section of the law violated and the remedy requested. The ADA Officer shall have ten calendar days in which to investigate and resolve the complaint. If the complainant is not satisfied with the ADA Officer's findings, the complainant may file a complaint with the City Administrator, who shall have ten calendar days to attempt to settle the matter. The City Administrator's decision shall be final. Section 4. The duties and responsibilities allocated within this plan are intended solely for the internal guidance of the City of Ashland. Nothing in this plan creates or authorizes or is intended to create or authorize any past or future private right of action by any individual, group of individuals, organization or corporation alleging non-compliance or seeking compliance with the ADA or its regulations.
