HomeMy WebLinkAbout1992-14 Catalina Medical ClinicA RESOLUTION TO ESTABLISH A REWARD FOR INFORM3%TION LEADING TO THE APPREHENSION AND CONVICTION OF PERSONS RESPONSIBLE FOR THE DAMAGE TO CATALINA MEDICAL CLINIC RECITALS: A. The citizens of Ashland are shocked and angry and will not tolerate the senseless act of violence resulting in the damage to the Catalina Medical Building on April 11, 1992, B. We stand united in our outrage and desire to take aLIi lawful actions necessary to apprehend the person or persons responsible, and C. Because responsible citizens have come forward to, indicate their desire to establish a reward for the apprehension and conviction of the offenders, THE MAYOR AND CITY COUNCIL OF ASHLAND RESOLVE AS FOLLOWS: Section 1. Reward Account Established. The city shall establish an account within its general fund for the deposit of money from persons who wish to establish a reward for the apprehension and conviction of the person or persons responsible for the damage to the Catalina Medical Building, 246 Catalina Street, Ashland, Oregon, which occurred on April 11, 1992. Section 2. Reward. The City shall pay all money deposited in the reward account to the person or persons who submit information to a law enforcement agency leading to the apprehension and conviction of the offender or offenders responsible for the damage to the Catalina Medical Building. This offer is subject to the following conditions: A. No reward shall be payable unless the offender or offenders are apprehended Within two years of the date of this resolution. B. No reward shall be payable unless the offender is legally convicted under a judgment which is final, or, if for any reason the case is not tried or is otherwise disposed of, upon proof of the offender's commission of such act. C. In no event shall the reward or combination of rewards exceed the amount deposited in the account established for such purpose regardless of the number of offenders involved in the act or regardless of the number of persons who supply information leading to the apprehension and conviction of such offenders. D. Officers and employees of the city of Ashland, officers of state and local police forces and officers of the federal government shall not be eligible to receive rewards. PAGE i-REWARD RESOLUTION (D:dai,y\~eward.~es) E. The City may apportion such reward among two or more who give information leading to the apprehension and conviction of an offender. F. The City shall be the sole and final judge of the right of any claimant to a reward. Section 3. Termination and refund. The City Council shall have the authority to terminate this offer at any time it determines it to be in the best interests of the city. If for any reason rewards are not made the money in the account shall be refunded, upon request, to those who donated twenty dollars or more. All money not refunded shall be deposited in the City's general fund for use by the City. The foregoing resolution was READ and DULY ADOPTED at a special meeting of the City Council of the City of Ashland on April 14, 1992.
