PERMANENT UTILITY EASEMENT
Archerd & Dresner, LLC, an Oregon Limited Liability Company ("Grantor") hereby
grants to the City of Ashland, Oregon ("Grantee") a non-exclusive public utility easement over
and across Lot 1, Block "X" of the Railroad Second Addition to the City of Ashland, within
Tract A of Instrument No. 03-36246 of said Official Records, lying situate within tlhe Northeast
Quarter of Section 9, within Township 39 South, Range 1 East of the Willamette Meridian,
Jackson County, Oregon. The boundaries of the easement being granted are more particularly
described on Exhibit "A" attached hereto.
Purpose of Easement. The purpose of the easement is to allow Grantee to construct,
reconstruct, install, use, operate, inspect, repair, maintain, remove and replace utility
facilities including but not limited to, lines for electricity, sewer, water, gas and
telecommunications on real property described on the attached Exhibit A and further
referred to in this Easement Agreement as the "Easement Area".

Use of Surface. Grantor shall have the fight to use the Easement Area for all purposes
not inconsistent with the uses and purposes of the property, provided that Grantor shall
not build or place any structure upon the Easement Area without the prior written consent
of Grantee.

Access to Easement Area. Grantee, its agents, independent contractors and invitees shall
have the right of ingress and egress to the Easement Area for the purposes connected with
this easement. Specifically, Grantee, its agents, independent contractors and invitees
shall have the right of ingress and egress to the Easement Area to construct, maintain,
replace, reconstruct, or remove utilities facilities within the easement. Grantee agrees to

restore the premises of the Grantor, and any improvements disturbed by the Grantee, as
near as practicable.
Prior Encumbrances. This easement is granted subject to all prior easements or
encumbrances of record.

A variable width Public Utility Easement to the City of Ashland, Oregon, over :md across
Lot 1, Block "X" of the Railroad Second Addition to the City of Ashland, within Tract A
of Instrument No. 03-36246 of said Official Records, lying situate within the Northeast
Quarter of Section 9, within Township 39 South, Range 1 East of the Willamette
Meridian, Jackson County, Oregon, more particularly described and bounded as; follows,
to wit;
Commencing at the Southwest comer of Donation Land Claim No. 43 in Tovmship 39
South, Range 1 East of the Willamette Meridian in Jackson County, Oregon; thence
North 00006'48', East, along the West line of said described Claim No. 43, a distance of
624.48 feet to the northeast comer of Lot 1, Block "X" of the Railroad Second Addition
to the City of Ashland, Oregon, according to the official plat thereof, lying on the
southerly line o.f"B" Street and being the POiNT OF BEGINNING of a variable width
strip of land, heretofore described; thence North 74°12'21" West, along said southerly
line of"B" Street, a distance of 4.70 feet; thence South 00006'48'' West, leaving said
southerly line, a distance of 26.56 feet to a point'of curvature; thence 45.12 feet along the
arc of a 224.00 foot radius curve to the left, having an included angle of 11 °32'24"
(Chord bearing South 05039'24'' East, 45.04 feet), to the said described West line of
Donation Land Claim No. 43; thence North 00006'48" East, along said West line, a
distance of 70.10 feet to the POINT OF BEGINNING.
