PERMANENT UTILITY & PEDESTRIAN EASEMENT FOR CITY OF ASHLAND
1. Grant of easement. The above named Grantors grant to the City of Ashland, Oregon,
"Grantee," a perpetual non-exclusive easement in gross to construct, reconstruct, install, use,
operate, inspect, repair, maintain and remove and replace public utility facilities and public
pedestrian access facilities including a sidewalk across, along and upon the real property
described below and further referred to in this easement agreement as the "easement area."
The easement area is located in Jackson County, Oregon, and is described on the attached
Exhibit A.
2. Use of surface. Grantors shall have the right to use the easement area for all pu~'poses not
inconsistent with the uses and purposes of the property, provided that Grantors shall not build or
erect any structure upon the easement area without the prior written consent of Grantee.
3. Prior Encumbrances. This easement is granted subject to all prior easements or
encumbrances of record.

Commencing at the point of intersection of the centerline of East Main Street with
the centerline of Walker Avenue in the City of Ashland, Jackson County, ~Oregon as
said intersection is shown on the Major Land Partition filed as survey No. 10905 in
the office of the Jackson County Surveyor; thence along the centerline of said
Walker Avenue, South 00°11'19" East, 240.48 feet; thence leaving said centerline,
North 89°48'41" East, 30.00 feet to a point on the easterly line of said Walker
Avenue, said point being also the Point of Beginning of the lands herein described;
thence leaving said easterly line, North 04038'55" East, 99.62 feet; thence North
00°11'19" West, 100.45 feet to the beginning of a curve concave to the southeast
having a radius of 10.00 feet; thence northeasterly 15.86 feet along said curve
through a central angle of 90053'44" to the point of tangency with the southerly line
of said East Main Street; thence along said southerly line, North 89°17'35" West,
18.56 feet to said easterly line of Walker Avenue; thence along said easter'ly line,
South 00°11'19" East, 210.01 feet to the Point of Beginning.
