PERMANENT BICYCLE AND PEDESTRIAN EASEMENT FOR CITY OF ASHLAND
1. Grant of easement. The above named Grantor grants to the City of Ashland, Oregon,
"Grantee," a perpetual non-exclusive easement in gross to construct, reconstruct,
install, use, operate, inspect, repair, maintain and remove and replace a public
pedestrian easement and sidewalk across, along and upon the real property described
below and further referred to in this easement agreement as the "easement area."
The easement area is located in Jackson County, Oregon and is described on the
attached Exhibit A.
2. Use of surface. Grantor shall have the right to use the easement area for all purposes
not inconsistent with the uses and purposes of the property, provided that Grantor shall
not build or erect any structure upon the easement area without the prior written
consent of Grantee.
3. Prior Encumbrances. This easement is granted subject to all prior easements or
encumbrances of record.

SIDEWALK EASEMENT
HEYERMAN PROPERTY
An easement across a portion of that real property described in Document Number 02-
64968, of the Official Records of Jackson County, Oregon, being located in the
Northwest One-quarter of Section 14, Township 39 South, Range 1 East of the
Willamette Meridian, in the City of Ashland, Jackson County, Oregon, and more
particularly described as follows:
Beginning at the southwest comer of said document, being the southwest comer of Parcel
2 of Partition Plat Number P-37-2001 of the Partition Plat Records of Jackson County,
Oregon, and also being a point on the easterly right of way of Tolman Creek Road;
thence along said boundary and right of way, North 00°02'19'' West, 5.25 feet; thence
leaving said boundary and right of way, South 27°19'02" East, 5.91 feet to a point on the
south boundary of said document and plat; thence along' said boundary, North 89057'28"
West, 2.71 feet to the Point of Beginning.
Containing 7.11 square feet, more or less.
The sidelines of this easement are to be prolonged or shortened as to meet at angle points,
to begin at the southwest comer of aforementioned document, thence along the west
boundary thereof, thence southeasterly to a point on the south boundary, thence end at the
southwest comer thereof.
Basis of description is the centerline monuments tied or set by Survey Number 16604, as
filed in the office of the Jackson County Surveyor.
