An ordinance vacating a portion of Prospect Street in the City
of Ashland, Jackson County, Oregon, and requiring the City Recorder
to certify a copy of this ordinance to the County Clerk, County
Engineer and County Assessor.
WHEREAS, by petition signed by all of the adjoining property
owners, it has been requested th8.t the City of Ashland vacate that
portion of Prospect Street hereinafter described, and
WHEREAS, the fallowing argllillents have been presented as a reason
for said vacation:
(a) The hillside is so steep as to require excessive cuts
and fills if streets are kept wide.
(b) This extension of Prospect need not be a wide street,
since it will provide access to a limited number of
building sites; there is little likelihood that the
street would ever carry enough cross-town traffic to
warrant putting up wi~h the difficulties associated
with a wide street.
(c) The present +ight of way elevation gives good access
to properties adjacent to the south side of the right
of way. Cutting the road level to provide equal cut
and fill would place the road level about 3t feet
below the south property lines.
(d) The proposed 25 foot right of way would make it possible
to retain several large trees on the north side of the
street which are 12 to 14 feet within the present right
of way.

vJHEREAS, the Common Council does hereby find that said arguments
are valid, and
\vHEREAS, due notice of said vacation has been given :in the manner
and form required by law, ~nd the .Planning Commission having recommended
said vacation, and the Common Council having conducted a hearing thereon,
and it appearing to the Common Council that the public convenience and
welfare will be served thereby and that this vacation is ln the public
interest, NOW, THBREFORE,
THE PEOPLE OF THE CITY OF ASHLAND DO ORDAIN AS }i'OLLOHS:

That all of that portion of Prospect Street describ<<::d as follows:
The North 15 feet of Prospect Street from the West 4~nd
of right of way to the West line of South Mountain Avenue
extended and more particularly described as follows:
Beginning at the Northeast corner of the West Half of the
Southeast Quarter of the Northeast Quarter of Section 16,
Township 39 South, Range 1 East of the Willamette ME~ridian
in the City of Ashland, Jackson County, Oregon; thence
North 5 feet to the point of beginning; thence West 42.6
feet; thence North 15 feet to a point on the North line
of said Prospect Street; thence East along said street
352.6 feet to the West line of South Hountaln AvenuEI
extended; thence South 15 feet; thence West 3l0.~ feet
to the point o~ beginning.
be, and the same is hereby, vacated.
Section 2.
That the City Recorder is hereby directed to deliver a certified
copy of said ordinance to the County Clerk, County Engineer and County
Assessor of Jackson COQnty, Oregon.
The foregoing ordinance was duly passed, under a suspension of
the rules, at a regular meeting of the Common Council held on the
~ day of June, 1959, the vote being as follows:
