Consideration: Valuable Consideration as set forth in Donation Agreement
Send Tax Statements To: City of Ashland, 20 East Main Street,
Ashland, OR 97520
WILLIAM DAVID BURNS, who took title as William David Burnson, and KATRINA
SON, who took title as Katrina Burnson, Grantors, convey and warrant to CITY OF
ASHLAND, Grantee, the following real property described on the attached Exhibit A
free of encumbrances except as specifically set forth herein, so long as said property is
used for open space/nature preserve. In the event Grantee ceases to use the property
for open space/nature preserve, title to the property shall vest in the Nature
Conservancy, Oregon Chapter for use as a nature preserve.
THIS INSTRUMENT WILL NOT ALLOW USE OF THE PROPERTY DESCHIBED IN
THIS INSTRUMENT IN VIOLATION OF APPLICABLE LAND USE LAWS AND
REGULATIONS. BEFORE SIGNING OR ACCEPTING THIS INSTRUMENT, THE
PERSON ACQUIRING FEE TITLE TO THE PROPERTY SHOULD CHECK WITH THE
APPROPRIATE CITY OR COUNTY PLANNING DEPARTMENT TO VERIFY
APPROVED USES AND TO DETERMINE ANY LIMITS ON LAWSUITS AGAINST
FARMING OR FOREST PRACTICES AS DEFINED IN ORS 30.930.
The true and actual consideration for this conveyance and easement is TEN DOLLARS
($10.00) and good and valuable consideration.
