PERMANENT STORM DRAINAGE EASEMENT FOR CITY OF ASHLAND
1. Grant of easement. The above named Grantor grants to the City of Ashland, Ore~10n,
"Grantee," a perpetual non-exclusive easement in gross to construct, reconstruct, install, use,
operate, inspect, repair, maintain and remove and replace a storm drain pipeline on real property
described below and further referred to in this easement agreement as the "easement area."
The easement area is located in Jackson County, Oregon, and is described as follows:
See the attached Exhibit A.
2. Use of Area. Grantors shall have the right to use the easement area for all purposes not
inconsistent with the uses and purposes of the property, provided that Grantors shall not build or
place any structure upon the easement area without the prior written consent of Grantee.
3. Access to Easement Area. Grantee, its agents, independent contractors and invitees shall
have the right of ingress and egress to the easement area for the purposes connected with this
easement.
4. Notice. Grantee, its agents, independent contractors and invitees shall, upon every occasion
that such storm drainage facilities are constructed, maintained, replaced, reconstruGted, or
removed, provide Grantors reasonable notice and restore the premises of the Grantors,
disturbed by Grantee, as near as practicable.

5. Termination. All rights hereunder shall cease if and when the easement area ceases to be
used for public utility purposes.
6. Prior Encumbrances. This easement is granted subject to all prior easements or
encumbrances of record.

A variable width storm drainage easement to the City of Ashland, over and across the
northerly portion of Lots 1 & 2, Block 3 of Faith Subdivision in the City of Ashland,
Oregon, according to the official plat thereof, now of record, lying situate within the
Northeast Quarter of Section 15, within Township 39 South, Range 1 East of the
Willamette Meridian, Jackson County, Oregon, more particularly described and bounded
as follows, to wit;
BEGINNING at a 5/8 inch iron pin at the northeast comer of Lot 1, Block 3, Faith
Subdivision in the City of Ashland, Oregon, according to the official plat thereof, now of
record in Jackson County, Oregon; thence South 00001 '32" East (Plat Record South
0010' East), along the East line of said described Lot 1, a distance of 10.00 feet; thence
North 88004'08" West, leaving said East line, a distance of 130.77 feet to the West line
of Lot 2, Block 3, of said Faith Subdivision; thence North 03014'16" East (Plat Record
North 2048' East), a distance of 6.00 feet to a 5/8 inch iron pin at the northwest comer of
said described Lot 2; thence South 89049'32" East, a distance of 130.35 feet (Plat Record
South 89059' East, 131.40 feet) to the POINT OF BEGINNING.
