AN ORDINANCE AMENDING ORDINANCE NO. 1361, THE ZONING
ORDINANCE OF THE CITY OF ASHLAND, AND SECTION 18.12.030
OF THE ASHLAND MUNICIPAL CODE, TO REZONE CERTAIN PROPERTY
FROM R-3:l.2 (Multiple Family Residential) TO C-l
(RETAIL COMMERCIAL.)
THE PEOPLE OF THE CITY OF ASHLAND DO ORDAIN AS FOLLOWS:
SECTION 1. That Ordinance No. 1361 and Section 18.12.030 of the
Ashland Municipal Code be, and the same hereby is, amended to rezone
from R-3:l.2 (Multiple-family Residential) district, to C-l, (Retail
Commercial) District, the following described real property, to-wit:
PARCEL NO.1:
Beginning at a point on the North line of the Boulevard, in the City of
Ashland, Jackson County, Oregon, 21 feet South, of the Southeast corner
of Donation Land Claim No. 45, Township 39 South, Range 1 East, Willam-
ette Meridian, Jackson County, Orrgon; thence North, along the East line
of said Donation Land Claim, and its extension thereof, 135.0 feet; thence
East 269.0 ft; thence South, 314.97 feet, more or less, to the Northerly
line of said Boulevard; thence North 560 13' West, along said Boulevard,
323.66 feet, more or less, to the point of beginning.
EXCEPTING THEREFROM that portion of the above described premises conveyed
by George W. Goswick and Iva R. Goswick, husband and wife, to Curtis B.
Phelan and Barbara E. Phelan, husband and wife, by deed dated March 20, 1962,
recorded March 22, 1962, in Volume 523, Page 71, Jackson County, Oregon,
Deed Records, more particularly described as follows: Beginning at the
Southeast corner of Donation Land Claim No. 45, Township 39 South, Range 1
East, Willamette Meridian, Jackson County, Oregon; thence North 0004' West,
along the East line of said claim, 114.0 feet; thence East, 195.28 feet;
thence South 31020' West, 220.92 feet, to the Northeasterly right of way
line of Highway No. 99; thence North 56013' West, along said line, 96.57
feet; thence North, 21.0 feet, to the point of beginning.
The foregoing ordinance was first read on the 19th day of June, 1979
and duly PASSED and ADOPTED this 3rd day of July, 1979.
